• • <br />5.7 The variance, if �ranted, will not alter the essential character of the locality. While the <br />fence height limit serves important purposes, granting the present VARIANCE would <br />simply allow the applicant to construct a continuous and uniform fence in a location that <br />is literally inches away from the very same fence would be permitted. Planning Division <br />staff has therefore determined that granting the vAR�AtvcE would not alter the essential <br />character of the locality. <br />6.0 STAFF RECOMMENDATION <br />Based on the comments and findings outlined in Section 5 of this report, Planning <br />Division staff recommends approval of a vAR1ANCE to the fence height requirement <br />established in § 1013.02C of the City Code to allow the proposed 6-foot-tall fence along <br />the western property line at 826 County Road D. <br />7.0 SUGGESTED ACTION <br />ADOPT VARIANCE BOARD RESOLUTION 88 approving a VARIANCE to Section 1013 of the <br />City Code that would allow the consh-uction of the proposed fence, based on the <br />comments and findings of Section 5 and the recommendation of Section 6 of this report. <br />8.0 NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed. The appeal period <br />remains open for 10 days from the date of the decision, and an appeal may be made either <br />by the applicant or by another Roseville property owner. <br />8.2 An appeal must be submitted in writing to the City Manager by noon on May 17, 2010 <br />for a hearing before the City Council. <br />8.3 If no appeal is filed, a building permit may then be issued, and Community Development <br />staff will mail the resolution approving the variance to Ramsey County for recording <br />against the subject property. <br />8.4 Pursuant to § 1013.03 of the City Code, the variance will expire 6 months after the <br />approval date if a fence permit is not issued. <br />Prepared by: City Planner Thomas Paschke (651-792-7074) <br />Attaclmients: A: Area map C: Site plan and photos <br />B: Aerial photo D: Draft of Variance Board Resolution #88 <br />PF10-012 RVBA 050510 <br />Page 3 of 3 <br />
