4.O BACKGROUND <br />4.1 George C. Brandt, Inc. owns the property at 2975 Long Lake Road, which has a <br />Comprehensive Land Use Plan designation of Industrial (I) and a zoning classification of <br />Limited Industrial (I-1) District. This request for co1vD�TtoNA[, [1sE approval has been <br />prompted by the applicant's desire to install cellular phone transmission equipment on a <br />monopole facility. <br />4.2 While Section1013.10A3 of the City Code specifically addresses City-owned towers, this <br />section nonetheless requires the installation of new, additional antennas onto existing <br />tower facilities where feasible, presumably to minimize the number of new towers that <br />are built. This same requirement had been further interpreted by Planning Division staff <br />as tacitly encouraging new towers, when new towers are needed, to accommodate <br />multiple providers so that the towers might more feasibly allow future providers to install <br />their equipment on these then-existing towers. In light of this, staff has begun requiring <br />new proposals for telecommunication equipment to address accommodations for <br />potential future providers as well as the specific provider which may have prompted an <br />application; the present application complies with this requirement since it includes <br />locations on the facility that can accommodate up to two additional, future service <br />providers. <br />S.O STAFF COMMENTS <br />5.1 Section 1013.10A4 (Commercial Antennas on Non-City Sites) of the City Code allows <br />commercial telecommunication antennas (with or without towers) on privately-owned <br />properties as co1vD[T�otvA�, usES in Business and Industrial zoning districts, and <br />§ 1013. l 0A8 (Existing Facilities) further requires telecommunication facilities to be <br />"dismantled and removed from the site within one year" after the equipment is no longer <br />in use. If this proposed co1v�IT[o1vA�. UsE application is approved, any future equipment <br />which fits within the scope of the approval would be considered permitted, and new <br />providers could add their equipment when former providers have removed their <br />equipment, as required, within a year of disuse. Moreover, at such time as no transmitting <br />equipment has remained active on the tower for a period of 1 year, the tower itself would <br />have to be removed, but the approved CoNDCTIOtvAL usE would remain valid on the <br />property in perpetuity, and a new tower facility could be erected if future demand <br />presented itself. <br />5.2 Section 1014.01 (Conditional Uses) of the City Code requires the Planning Commission <br />and City Council to consider the following criteria when reviewing a coND[T�otvAL usE <br />application: <br />• Impact on traffic; <br />• Impact on parks, streets, and other public facilities; <br />� Compatibility of the site plan, internal traffic circulation, landscaping, and <br />structures with contiguous properties; <br />• Impact of the use on the market value of contiguous properties; <br />• Impact on the general public health, safety, and welfare; and <br />� Compatibility with the City's Comprehensive Plan. <br />PF 10-021 RPCA 09a 110 <br />Page 2 of 2 • <br />. • <br />
