• • <br />this PUD came to comprise several separate properties with as many different owners, <br />rather than a single entity owning the entire development. For this reason, staff will be <br />considering the daycare use on only the property owned by the applicant. In reviewing <br />the proposal as applied to just the building at 2890-2900 Centre Pointe Drive, the <br />building would remain more than 50% office uses and, at about 11,000 square feet, the <br />proposed facility would be about 3% of the existing office development or about 1.5% of <br />the potential development at full build-out. For this same reason, Planning Division staff <br />is proposing to amend the PUD by attaching a resolution approving the amendment to the <br />PUD agreement as an addendum; in this way, the PUD can be amended pertinent to one <br />specific property without requiring the endorsement of all the varied property owners. <br />5.5 Parking on the property is generally agreed to be inadequate even though the site was <br />developed as approved by the PUD. Nevertheless, the number of parking spaces required <br />for daycare uses is roughly half of the requirement for office uses, so even if the proposed <br />daycare doesn't naturally help to relieve the current parking pressure, the daycare use <br />should not be saddled with that burden through parking-related conditions of approval. <br />6.0 PUBLIC HEARING <br />The duly noticed public hearing for this application was held by the Planning <br />Commission at its meeting of October 6, 2010. No members of the public were present to <br />comment on the proposal and draft minutes of the public hearing were not available at the <br />time this report was written. After reviewing the application and speaking with the <br />applicant, the Planning Commission voted unanimously (i.e., 6-0) to recommend <br />approval of the proposed PUD AtvlEtvDtvtENT. <br />7.0 RECOMMENDATION <br />Based on the comments and findings in Section 5-6 of this report, Planning Division staff <br />concurs with the recommendation of the Planning Commission to approve a PUD <br />A�vtENDNtEtv1' to allow a daycare facility at 2890-2920 Centre Pointe Drive, subject to the <br />following conditions: <br />a. The daycare facility shall not exceed 11,000 square feet; and <br />b. An external recreation area shall not be allowed on site since there does not <br />appear to be adequate space without eliminating some of the existing parking <br />area. <br />H.O SUGGESTED ACTION <br />Adopt a resolution approving the proposed PUD AMENnMENT for Schadegg <br />Development LLC to allow daycare as a permitted use at 2890-2920 Centre Pointe Drive, <br />based on the comments and findings of Section 5-6 and the recommendation of Section 7 <br />of this report. <br />Prepared by: Associate Planner Bryan Llo,yd (651-792-7073) <br />Attachments: A: Area map C: Applicant narrative <br />B: Aerial photo D: Draft resolution <br />PF10-02?
