AMENDMENT TO PLANNED UNIT DEVELOPMENT AGREEMENT #1177 <br />WHEREAS Planned Unit Development Agreement #1177 (herein referred to as the <br />"Agreement") creating the Centre Pointe Business Park was approved on April 11, 1997 and <br />entered into between the City of Roseville, a Minnesota municipal corporation (herein referred to <br />as the "City") and Ryan Twin Lakes Limited Partnership. On October 11, 2010 the Roseville City <br />Council adopted City Council Resolution # approving an amendment affecting Section 7 of the <br />Agreement and pertaining to the property legally described as: Centre Pointe Business Park part <br />of Lot 1 Block 3 lying S of N 280 feet of said Lot 1 as measured on E line of said Lot 1 and also <br />Lot 2 Block 3, PIN# OS-29-23-14-0026, (herein referred to as the "Property"). <br />WHEREAS the amended Agreement allows an adult or child daycare use on the Property in addition to <br />the uses otherwise allowed by the Agreement, subject to the following conditions: <br />a. The daycare facility shall not exceed 11,000 square feet; and <br />b. An external recreation area shall not be allowed on site since there does not <br />appear to be adequate space without eliminating some of the existing parking <br />area. <br />THE AMENDED AGREEMENT IS HEREBY CONFIRMED AND CONTINUED by the City and <br />the current owner of the Property, Schadegg Development LLC, 225 Bridgepoint Drive, South Saint Paul, <br />Minnesota 55075, and any heirs, successors, or assigns. <br />
