u � EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 28`�' day of January, 2008, at 6:00 p.m. The following members were present: Pust, Roe, Ihlan and Mayor Klausing; and Kough were absent. Council Member Roe introduced the following resolution and moved its adoption: RESOLUTION NO. 10592 A RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT AMENDMENT IN ACCORDANCE WITH §1006 AND §1008 OF THE ROSEVILLE CITY CODE FOR HAR MAR MALL, 2100 SNELLING AVENUE (PF07-062) WHEREAS, Gateway Washington, Inc. is the owner of property at 2100 Snelling Avenue; and WHEREAS, the subject property is legally described as: See Attachment A WHEREAS, the property owner through its agent Emmes Realty Services LLC, seek an amendment to the Har Mall PLANNED UNIT DEVELOPMENT created in 2000 to allow for the redevelopment of the former Backyard Grill restaurant; and WHEREAS, the proposal would include the demolition of the existing 6,900 sq. ft. structure afford the development of up to a 7,200 sq. ft. sit-down restaurant near Snelling Avenue and the adjacent signalized access to the Mall; and WHEREAS, the Roseville Planning Commission held a public hearing on December 5, 2007 regarding the requested PLANNED LTNIT DEVELOPMENT AMENDMENT, voting 5-2 to recommend approval of the request based on the comments and findings of the project report dated the same; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the request by Gateway Washington, Inc. for an AMENDED PLANNED LTNIT DEVELOPMENT at Har Mar Mall, subject to the following conditions; 1. The final sit-down restaurant structure shall be limited to a size of 7,200 sq. ft. or less.
