u <br />� <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 28`�' day of January, 2008, at 6:00 p.m. <br />The following members were present: Pust, Roe, Ihlan and Mayor Klausing; <br />and Kough were absent. <br />Council Member Roe introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 10592 <br />A RESOLUTION APPROVING A PLANNED UNIT DEVELOPMENT AMENDMENT <br />IN ACCORDANCE WITH §1006 AND §1008 OF THE ROSEVILLE CITY CODE FOR <br />HAR MAR MALL, 2100 SNELLING AVENUE (PF07-062) <br />WHEREAS, Gateway Washington, Inc. is the owner of property at 2100 Snelling <br />Avenue; and <br />WHEREAS, the subject property is legally described as: <br />See Attachment A <br />WHEREAS, the property owner through its agent Emmes Realty Services LLC, seek an <br />amendment to the Har Mall PLANNED UNIT DEVELOPMENT created in 2000 to allow for the <br />redevelopment of the former Backyard Grill restaurant; and <br />WHEREAS, the proposal would include the demolition of the existing 6,900 sq. ft. <br />structure afford the development of up to a 7,200 sq. ft. sit-down restaurant near Snelling Avenue <br />and the adjacent signalized access to the Mall; and <br />WHEREAS, the Roseville Planning Commission held a public hearing on December 5, <br />2007 regarding the requested PLANNED LTNIT DEVELOPMENT AMENDMENT, voting 5-2 <br />to recommend approval of the request based on the comments and findings of the project report <br />dated the same; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Gateway Washington, Inc. for an AMENDED PLANNED LTNIT <br />DEVELOPMENT at Har Mar Mall, subject to the following conditions; <br />1. The final sit-down restaurant structure shall be limited to a size of 7,200 sq. ft. or <br />less. <br />
