EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 27th day of February, 2006, at 6:00 <br />p.m. <br />The following members were present: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT <br />FOR BIG CITY VENTURES, INC AND OOPS THEATER, IN ACCORDANCE WITH <br />SECTION 1013 OF THE ROSEVILLE CITY CODE, ALLOWING "LIVE <br />ENTERTAINMENT" WITHIN A PORTION OF THE LOWER LEVEL BANQUET <br />AREA OF THE RESTAURANT AT 2801 SNELLING AVENUE (PF3709) <br />WHEREAS, Big City Ventures, Inc. and Oops Theater have requested a CONDITIONAL <br />USE PERMIT in accordance with Section 1013 of the Roseville City Code to allow "live <br />entertainment" (dinner theater) to occupt a portion of the existing lower lever banquet area of Big <br />City Tavern; and <br />WHEREAS, the property 2801 Snelling Avenue is legally described as: <br />Lot 2, Block 1, Slawik Park Second Addition and the vacated street accruing and part of <br />the North 376.46 feet of Outlot C Slawik Park, lying South of the Northeasterly line of Lot <br />2, Block 1 Slawik Park Second Addition, excluding the South 50 feet <br />PIN 04-29-23-41-0041 <br />WHEREAS, Section 1005.015 requires "live entertainment" when associated with a <br />Class IV — Traditional restaurant to receive a Conditional Use Permit consistent with Section <br />1013 of the Roseville City Code; and <br />WHEREAS, the proposal by Big City Ventures and Oops Theater seeks to utilize the <br />Twin Cities Room (lower lever banquet room) within the Big City Tavern as a dinner theater; <br />and <br />WHEREAS, the Planning Commission held a public hearing on February 1, 2006 <br />concluding that the proposal is consistent with the criteria of Section 1013 of the Roseville City <br />Code; <br />WHEREAS, the Planning Commission voted (6-0) to recommend approval of the <br />request, subject to 4 conditions. <br />
