5.6 Health Safety. There appears to be no impact on general health, safety, and public <br />welfare. <br />5.7 Comprehensive Plan. As a restaurant (with or without live entertainment), the project is <br />a compatible use with the Comprehensive Plan designation as a business use. <br />6.0 STAFF RECOMMENDATION: <br />6.1 Based on the information and findings provided in Section 4 and 5 of this project report, <br />the City Planner recommends approval of a CONDITIONAL USE PERMIT to allow <br />Oops Theater to utilize/occupy a portion of the existing banquet area (Twin Cities Room) <br />in the lower lever of Big City Tavern, 2801 Snelling Avenue, subject to the following <br />conditions: <br />A. The owner (Big City Ventures LLC) must enter into a"Proof of Parking <br />Agreement" with the Community Development Department per Section 1018.12 <br />of the Roseville City Code. <br />B. The theater must store all props and displays within the building or within a <br />screened enclosure on the premises approved by the Community Development <br />Department. <br />C. The theater signage will be considered as a separate business within a multi-tenant <br />building and must meet the requirements of Section 1009 of the Roseville City <br />Code. <br />D. All performances of the theater must occur indoors. <br />7.0 PLANNING COMMISSION ACTION: <br />7.1 On February 1, 2006, the Roseville Planning Commission held the public hearing <br />regarding the Big City Venture/Oops Theater request. At the meeting, no citizens were <br />present to address the Commission. However, the Commission did have questions of the <br />City Planner regarding parking (see attached PC Draft Minutes). <br />7.2 The Commission voted (6-0) to recommend approval of the request by Big City Ventures, <br />Inc. and Oops Theater for a CONDITIONAL USE PERMIT at 2801 Snelling Avenue <br />allowing "live entertainment" within a portion of the lower level banquet area of Big City <br />Tavern, based on the findings of Section 5 and the conditions of Section 6 of the project <br />report dated February 1, 2006. <br />8.0 SUGGESTED CITY COUNCIL ACTION: <br />8.1 ADOPT a RESOLUTION APPROVING a CONDITIONAL USE PERMIT for Big <br />City Ventures LLC, 2801 Snelling Avenue and Oops Theater, based on the findings of <br />Section 5 and conditions of Section 6 of the project report dated February 27, 2006. <br />Prepared by: Thomas Paschke (651-792-7074) Attachments: Location map, narrative, site plans, and aerial photo. <br />PF3709_ RCA_022706.doc Page 4 of 4 <br />
