REQUEST FOR CITY COUNCIL ACTION
DATE: 01-30-06
ITEM No.: 10.
Staff Approval: Manager Approval: Agenda Section:
DPW
Item Description: Consider Adoption of New City Code Section 906 - Property
Maintenance Code (PF3708)
1.0 Requested Action:
1.1 After the discussion of the proposed ordinance amending the City Code, Title 9, Section
906, by adding the International Property Maintenance Code, 2003 edition and
amendments thereto, the Council asked that the ordinance be placed on the January 30,
2006 Council agenda for adoption. Communications from Ihlan, Munson, and emails are
attached.
2.0 Background
2.1 On November 28, 2005, the City Council held a public hearing and took public testimony
regarding possible adoption of a new section of the City Code — Section 906 pertaining to
the International Property Maintenance Code (IPMC). On January 9, 2006, the
Council scheduled an additional discussion\study meeting (January 23, 2006) for
this item prior to possible adoption on January 30, 2006. On January 17th the HRA
held a hearing on another issue — rental licensing ordinance— wherein opponents to
that ordinance suggested better code enforcement especially relating to
overcrowding living conditions and parking. Some of these issues can be addressed
by adoption of the IMPC.
2.2 Attached is a staff response to the questions raised at the public hearing regarding the
Property Maintenance Code. (Attachment A)
2.3 At the request of Council Member Ilhan, attached is a comparison of the proposed new
code through the adoption of the International Property Maintenance Code and the
existing City Code. (Attachment B). Also attached (last items are Council Members
comments and responses from staff and City Attorney to language in IMPC.)
3.0 Proposed Housing Preservation / Maintenance Code
3.1 Staff is recommending that the City adopt a Property Maintenance Code to help preserve
and improve the appeal and value within Roseville's neighborhoods regardless of owner
or rental status. A Property Maintenance Code, as proposed, will help staff and property
owner become more efficient and cost effective in addressing common residential
maintenance issues such as those shown in attachment D.
3.2 The proposed ordinance would adopt the International Property Maintenance Code, 2003
Edition, with minor amendments to concur with the existing City Code and State
Building Code.
