<br />1(�8.1.2 Uasafe equipmeat. Ursafe equipment includes
<br />any boiler, he�ting eyuipment, elevator, mo��u�g stairway,
<br />electrical wiring or device, flammable Gquid containei:s or
<br />other equipment on the premises or within the st�uctme
<br />which is in such disrepair or conditiott that such eq�ipment
<br />is a hazard to ]ife, health, property or sai`ety of the public or
<br />occ��pants of the premises or structure.
<br />10$.1.3 Sfructure nnfitfcr3�uman oceupancy. A structure
<br />is unfit for human occupancy whenever �he code vfficial
<br />fit�ds that such structure is unsafe, unlawful or, becanse of
<br />the degree to which [he structure is in d.isrepair or lacks
<br />maintena«ce, is insanitaiy, vermin or rat i3�fested, contains
<br />tilth and contamination, ar lacks ventilation, illuminatioii,
<br />sanitary or lleating i'acilities or oCher essential equipment re-
<br />yuired by [his code, or hec�mse the location of the structure
<br />constitutes a haz�ird to the occupants of tl�e structtu�e or to
<br />the public.
<br />I.U8.1.4 L'nla�vful structure. An uitlawfu] stn�cture is one
<br />found in whole or in part to be occupied by more persons
<br />thzn permiued under [his cade, or was erected, altered or oc-
<br />c�ipied c�ntrary to lav��.
<br />1�8_2 Closing of vacant struetures. If the s[ruccure is vacan[
<br />and unfi[ for human habitation and occupancy, and is not in
<br />danger of suuctural collaPse, the code official is authorized to
<br />post a placard of conde�nnation on the premises and order the
<br />structure closed up so as not to be an attractive ntiis�nce. Upon
<br />failiue of the owner ro ciose up [he premises within ihe time
<br />specified in the �rder, the code official shall cause the premises
<br />to be closed and secured throu�h any available public agency or
<br />by contract or an��ingement by private persons and the. cosf
<br />thereof shal( be chareed against the real estate upon whidi the
<br />structure is located and shall be a lien apon such real estate and
<br />may be collecte�l by any other legal resource.
<br />1a8.3 Notice. Whenever the code oificial has condemned a
<br />structure or eyuipment under the provisions of this section, no-
<br />tice shalJ be posted in a conspicuous place in or about the sU2�c-
<br />ture affec[ed by such notice and sez��ed on the. awner or the
<br />person or persons responsible for tl�e stnictare or equipmen[ in
<br />accordance with Section 107.3. If the uotice pert�uns ko equip-
<br />ment, iY s6all also be placed oi� the condenlned equipment. The
<br />notice shali. be in the form prescribed in Sectic>n 1072.
<br />108.4 Placarding. Upon Failure of the o�vner or person respon-
<br />sible to comply with the notice provisions within the time
<br />a ven, the code ofticial shai] post on the pie.mises or on defec-
<br />tive equipment a placard bearing the word "Condemned" and a
<br />statement of the penalties pravided for occupying the premises,
<br />operatin� the eyuipment or removinb the placard.
<br />1QS.d.1 Placard removal. The code of{ciat shall remove
<br />the condemnatian placard whenever tie dF:fect or defects
<br />upon which the condemnation and placarctina action were
<br />based have been eliminated. Any person who defaces or re-
<br />moves a �ondercination pl�card without the approval of the
<br />code official shall be sub_jec[ ta tf�e penalties provided by
<br />this code.
<br />�1fD8.5 Prohibifed occupar�cy. Any occupied structure con-
<br />demned and placarded by the code c�fficial shall be vacated as
<br />ordered by Che code official. Any person who shall occupy a
<br />placarde�l premises or shall operate placarded equipmen[, 1nd

<br />any owner or any person responsible for the premises who shall
<br />1et airyone occupy a placarded premises or operate placarded
<br />eyaipinent shall be tiable for the penalties provided by this
<br />code.

<br />E�iERGENCY MEASl7RES
<br />I()9.1 Inus��nenf dar�ger. When, in the opinion of ti7e cade offi-
<br />cial, tliere is imminent danger of fai.lure or collapse of a build-
<br />ing or shvcture wllich endangers lit'e, or when any structure or
<br />part of a structure llas fa11ei1 and life is endangered by the occu-
<br />pation of ihe structure, or when there is actual or potential dan-
<br />ger to the buildinv occupants or trose in che proximity af any
<br />structure because of exPlosives, explosive fames or vapors or
<br />the presence of toxic fumes, gases or rnateriais, or operation of
<br />defective or dangerous e.quipment, fhe code o�ciat is hereby
<br />autllc�rized and empowered [o order and require the ocrupants
<br />to vse�i,e the prenvses forthwith. The code official shall cause
<br />to be posted at cach entrance co such structure a notice readin�
<br />as [ollows: "This Structure Is Unsafe at�d (ts Occupancy Has
<br />Been Prohibite� by ±h� Code ni-FCial." [t shzll l,e un]awful f�r
<br />a�iy person to enter such structure excepi for the purpose of se-
<br />cinzng the structure, makinQ the required repairs, removing the
<br />h��irdous condition or of demolishinc the same.
<br />�09.2 Temporary saf'�guards. Notwithstaudinb other provi-
<br />sions of tltis code, whe�ever, in the opinion ot�the code official,
<br />there i� i��ut�inent dau�e� due ti� an unsafe condition, the. code
<br />official shall order the necessary work to be done, :t;cluding the
<br />boardit�g up of open�ngs, to render such stnicture temporarily
<br />safe whether or not the le��ii procedure herein described has
<br />been inst.ituted; and shal] catise such other action to be taken as
<br />the code offcial deems necessary to meet such emergency.
<br />1093 Closing streets. When necessary for pt�blic safety, the
<br />code official shall temporarily close structures and close, or or-
<br />der the aufho;ity having jurisdicEion to ciose, sidewalks, streets,
<br />public ways and places adjacent to unsafe structures, and pro-
<br />hibit the sasne fr<�m being utilized.
<br />109.4 �mergency rePairs. For the purposes of this section_ the
<br />code official shall employ tbe necessary labor and materials to
<br />peiform the requited work as expeditiously as possible.
<br />i09.5 C��sts of etnergeney repairs. Costs incorred in the per-
<br />fonnance of emea�gency work shall be paid by the jurisdiction,

<br />structure is or was located For the recovery of sach coses.
<br />109.6 �3earing. Any person ordered to take emergency mea-
<br />sw-es shall comply wittl such order forth�vith. Any affected per-
<br />son shall [hereafter. upon petition directed to the appeals board,
<br />be afforded a hearia� as clescribed in this code.
