Code violations <br />are misdemeanors. not strict liability misdemeanors. Shoreview's code does appear to <br />allow interior inspections of all housing. I would propose removing this provision. But <br />overall, Shoreview's Property Maintenance Code is a much more appropriate model for ? <br />Roseville than the IPMC. • <br />r� � � M�°'d,,a,� v�'" � <br />• Shorcvicw's ordinance misses a vital component by only allowing for he writin of �" <br />court citation. The IPMC ordinance also allows the City to ta e abatement action <br />(afrer bringin'g the matter before City CouncIl for approval). Roseville has many <br />elderly residents who are not defiant, but merely unable physically or financially to <br />bring a property into compliance. Therefore, abatement is a necessary option. <br />However, property owners should be aware of their rights, and often these provisions <br />are difficult to find. It could be policy that staff would include the appeal provisions <br />^ whenever a violation case reaches an impasse. <br />• Shoreview has the same authority/limitation as Roseville when requesting entry into <br />a home. A court issued warrant is necessary if the resident denies entry. <br />• Shoreview's code is better than what Roseville currendy has, however, it is not as <br />well suited for Roseville's problems as the IPMC is: <br />o Abatement is a necessary option in Roseville to assist residents. <br />o Overcrowding in rental properties. <br />o Properties not being maintained (interior and exterior). <br />o Landlords not turning on furnaces. <br />o Smoke detectors and GFI receptacles in rental units to protect renters. <br />o The IPMC is a nationally recognized standard for health and safety. <br />Motion #2 <br />All provisions of the IPMC adopted as pan of the Roseville City Code shall be fully stated as part of the <br />city code, not by reference to the IPMC. <br />
