^ Motion #4 <br />Delete Section 101.2 (Scope) and amend it to clarify that the code applies only to exterior maintenance <br />of owner occupied structures and that interior standards and inspections apply only as to rental <br />licensing requirements. <br />This would make the scope of the maintenance code consistent with staff recommendations. <br />Interior health and life-safety standards should apply to owner occupied as well as <br />rentals. Staff is observing more and more homes where elderly residents are not <br />physically or financially able to maintain the interior of their homes. Some end up <br />garbage homes, some end up clutter homes, some can't repair roof and/or plumbing <br />leaks that extensively damage the interior of their home. These are often sold to <br />companies that perform minimal repairs and then rent them out, becoming a visual <br />nuisance to neighbors and lowering property values. <br />Motion #5 <br />Delete Section 104. 4(Right of Entry) <br />Instead, create inspection rights and procedures as part of the rental licensing code. <br />• Currently code enforcement staff (as with all other governmental bodies) is limited in <br />,._ its authority to enter a property by the Constitution. This Section merely clarifies that <br />the code enforcement officer must follow the law (which would in these cases require <br />a search warrant issued by a court). <br />.�•, <br />Motion #6 <br />Delete Section 106.3 (Prosecution of Violations) <br />This would remove the creation of strict liability misdemeanors, and the charging of liens <br />against the property. Leave existing enforcement ordinances and procedures in place. <br />Motion #7 <br />Delete Section 106.4 (Violation Penalties) and all of Section 107 <br />Leave existing enforcement ordinances and procedures in place. See, for example, the <br />Hopkins Property Maintenance Code. <br />• The violation penalties listed in Section 106.4 are authorities the city currently has <br />available for use now. <br />� <br />
