REQUEST FOR VARIANCE BOARD ACTION
DATE: 05/03/06
ITEM NO: 4b
Department Approval: Agenda Section:
BL/TRP PUBLIC HEARINGS
Item Description: George Schultz Trust driveway setback variance for properry located at
597 South Owasso Boulevard (PF3724).
1.0 REQUESTED ACTION:
1.1 The George Schultz Trust is requesting an 8-foot variance from Section 703.04 of the
City Code to reduce the required driveway access point setback from a street corner from
30 feet to 22 feet.
2.0 BACKGROUND:
2.1 The George Schultz Trust owns the property located at 597 South Owasso Boulevard.
The property is zoned R-1, Single Family Residential, and the Comprehensive Plan
identifies the property as Low Density Residential.
2.2 The City's Pavement Management Program and the reconstruction of South Owasso
Boulevard have prompted the variance request.
2.3 The proposed reduction of this setback would enable the George Schultz Trust to
maintain the driveway in its exact location.
3.0 STAFF COMMENT:
3.1 Section 703.04B(4) requires a minimum driveway access point setback from a street
corner of 30 feet. Based on the proposal, a variance is necessary to allow the existing
driveway to remain.
3.2 The Pavement Management Program and its reconstruction of South Owasso Boulevard
have initiated this request.
3.3 Section 1013.02 requires the applicant to demonstrate a physical hardship and to
demonstrate that no practical alternatives exist that would reduce the need for a variance.
3.4 Relocating the access point to meet the 30 foot setback would require major
modifications to the irrigation system and the existing driveway as it extends to the
garage.
3.5 The proposed variance, if granted, will not adversely affect the public health, safety, or
general welfare, provided standards/conditions are attached to ensure that future
redevelopment of the site is completed in accordance with the plans proposed by the
applicant at that time.
PF3724 RVBA 050306.doc Page 1 of 2
