REQUEST FOR COUNCIL ACTION <br />DATE: 02/04/04 <br />ITEM NO: 3.12 <br />Department Approval: Agenda Section: <br />DPW CONSENT <br />Item Description: Amendment to text of Business Zoning Districts within City Code <br />Section 1005 (PF3527) <br />(SECOND READING AND FINAL APPROVAL) <br />1.0 BACKGROUND: <br />1.1 The Planning Commission, Council and staff have been completing a systematic rewrite <br />of outdated portions of the City Code for three past three years. Attached is the draft of an <br />ordinance which would modify the Business Zoning District language and format. The <br />new format consolidated the dimensional requirements on one page (page 2) and also <br />consolidates the land uses allowed in each district into one standard chart, similar to the <br />work that was done earlier for the Residential Zoning Text. One of the obvious <br />advantages is that it reduces the repetitiveness of the Business Zoning text by <br />consolidation. In addition, it allows users to view a comparison of what other business <br />districts uses might be allowed (or prohibited). No significant changes have been made to <br />the dimensional requirements have been made. <br />1.2 This amendment, if passed, would eliminate approximately forty percent of the duplicated <br />text in this section of the code. Fore example, the uses are replicated by distance to a state <br />or federal highway. This is old language done when the city was still full of undeveloped <br />land near such roads. Today, the community is 99% developed and this separation issue <br />does not apply. <br />1.3 Staff has added the definitions for each zoning district section, providing a clearer <br />understanding of the uses which should be allowed therein. B-2 through B-4 and SC are <br />primarily retail use areas and should be characterized as such in the land use charts. B-1 is <br />a on-retail, limited office and B-1B is a limited office and retail area, both are near <br />residential uses, A B-6 zone is a mixed use Business Park that requires PUDs to make <br />them effective. <br />2.0 RECOMMENDATIONS: <br />On December 3, 2003, the Planning Commission held a public hearing regarding the <br />proposed changes to the City Code pertaining to business regulations and uses. The <br />Commission recommended approval of the draft ordinance dated December 3, 2003 and <br />attached. There were no additional public comments. <br />The Council reviewed the ordinance at study meeting on January 19 and held a first <br />reading on January 26, 2004. <br />
