REQU�ST FOR CITY COUNCIL ACTION <br />Department ApprovaL• City ManagerApproval: <br />��� <br />DATE: 09/25/06 <br />ITEM NO: (. <br />Agenda Section: <br />Item Description: APPEAL of the VARIAIANCE BOARD'S action to DENY the request <br />by Charles Weleczki & Todd Iliff for a VARIANCE to $1004.016 (Front <br />Yard Building Setback) to allow the construction of principal structure <br />within the required front yard on the vacant lot at Dale Court and Dale <br />Street (PF3781). <br />L1� BACKGROUND: <br />1.1 On Spetember 6,2006 the Roseville Variance Board held the public hearing regarding the <br />request by Charles Weleczki & Todd Iliff seeking a VARIANCE to § 1004.016 <br />(Residential Dimensional Requirements— Front Yard Building Setback) of the City Code. <br />1 he request sought support for allowing a iront yarci principai structure encroachment <br />which would afford greater design flexibility on the uniquely shaped lot. <br />1.� The Variance Board concluded that a"hardship" was self created and that a deviation to <br />the Code would not be characteristic of the adjacent neighborhood. The Variance Board <br />voted 3 to 0 to deny the request. <br />] �3� Section 1414.Q4C states that the City Council acts and the Board of Adjustment in <br />variance appeal actions and that an appeal must be acted upon by the City Council at their <br />next regularly meeting. <br />'�:4 REVIEW of REQiTEST: <br />2, � Charles Weleczki & Todd Iliff are seeking a VARIANCE to � 1004.016 (Residential <br />Dimensional Requirements— Front Yard Building Setback) of the City Code to allow the <br />construction of a new home with attached garage on the vacant parcel at Dale Court and <br />Dale Street. � <br />2.� Charles Weleczki owns tlie vacant parcel at Dale Court and Dale Street. The property is <br />zoned R-1, Single Family Residential, and the Comprehensive Plan identifiesthe property <br />as Low Density Residential. <br />�..3 The vacant lot was split off from a larger parcel in August of 2005.
