EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramse��, Minnesota, was held on the 25" day of September, 2006, at 6:00 <br />p,m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION N O. <br />A RESOLUTION DENYING A VARIANCE TO �1004.01G AND IN ACCORDANCE <br />WITH �1013.02 OF THE ROSEVILLE CITY CODE FOR CHARLES WELECZHI, <br />AND THE VACANT PARCEL AT DALE STREET AND DALE COLTRT {PF3781). <br />WIIEREAS, Charles Weleczki is the owner of the vacant developable parcel at Dale <br />Street and Dale Court; and <br />WHEREAS, the subject property is legally described as: <br />REQUI.RES LEGAL DESCRZPTLON <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to $1004.016 (Residential <br />Dimensional Requirements —Front Yard Setback) to allow greater flexibility in the design of a <br />principal structure on the uniquely shaped parcel at Dale Court and Dale Street; and <br />WI �REAS, The Roseville Variance Board held the public hearing regarding the <br />VARIANCE request, voting 3-0 to DENY based on their determination that "hardslups" were <br />not present and that the need for the variance was created by the applicantl�roperty owner; and <br />Wf�REAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council seeking the Council's support far the requested 15 front yard setback <br />VARIANCE; and <br />WHEREAS, the Roseville City Council concurs with the determination of the Variance <br />Board, determiningthe following finding of fact: <br />l. That the applicant had options available when the original land division was <br />approved in 2005 that could have increased the uniquely shaped parcel's size, <br />offering greater design flexibility without a variance. <br />2. That a principal structure with attached garage could be designed and constructed <br />on the parcel, however, said structure most likely would not be a traditional design <br />including large open living spaces and a three stall attached garage. <br />_� <br />
