4.0 REVIEW of REQUEST: <br />4.1 Walser Automotive Group (in cooperation with St. Paul Properties) has requested an <br />INTERIM USE PERMIT to allow the temporary relocation of their existing auto <br />service/repair facility affiliated with Walser Pontiac, Buick, GMC, 2775 Highway 35 to <br />the industrial building located at 2980 Cleveland Avenue. <br />4.2 On August 14, the City Council approved a CONDITIONAL USE PERMIT far Walser to <br />redevelopment the former McCarthy Pontiac, Buick, GMC site at 2775 Highway 35 and <br />on September 6, 2006 the Variance Board approved a VARIANCE allowing the proposed <br />parking lot to extend to the southern property line. <br />4.3 Since that date, Walser has been developing their final engineering and construction <br />documents, as well as contracting with a developer/builder. Recently Walser and their <br />contractor have been focusing on how to redevelop the existing structure while keeping <br />the auto service facility operating. The plan discussed with the Planning Commission and <br />City Council (though not approved as a condition in the CONDITIONAL USE PERMIT) <br />was to complete a two phase redevelopment that kept the existing service facility partially <br />operational while the new service facility was constructed. However, Walser has <br />concluded that the disruption to service operations and project construction as well as an <br />extended construction timeline is not in their or their customers' best interest. <br />4.4 Wasler contacted the City Planner to discuss their temporary use of an off-site facility. <br />The use of the property at 2980 Cleveland Avenue for auto service would require either a <br />CONDITIONAL USE PERMIT or an INTERIM USE PERMIT. Staff further commented <br />that because the request would be seeking temporary use of a site in Roseville during <br />construction, that the INTERIM USE PERMIT was the appropriate process for approval. <br />4.5 No exterior improvements are being proposed; only interior improvements such air <br />handling/exchange system and hydraulic vehicle lifts, would need to be reviewed and <br />approved by the City Building Official. <br />4.6 Section 1012.09A states: "The City Council may authorize an Interim Use Permit of <br />property. Interim uses may not be consistent with the land uses designated on the adopted <br />Land Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located." <br />4.7 Section 1012.09B states: "The City Council may attach conditions to Interim Use <br />Permits. In reviewing Interim Use Permit applications, the City will establish a specific <br />date or event that will terminate the use on the property. The Council will also determine <br />that the approval of the interim use would not result in adverse effects on the public <br />health, safety, and general welfare, and that it will not impose additional costs on the <br />public if it is necessary for the public to take the property in the future." <br />PF3793 RCA 111306.doc\ Page 2 of 4 <br />
