[Attachment A] Brian Ash plans to construct a 908-square-foot detached garage at 2550 Snelling Curve. A <br />Conditional Use Permit is required for an accessory structure of this size. <br />Following a public hearing at their December 6, 2006 meeting, the Planning Commission voted 7-0 to <br />recommend approval of the requested CONDITIONAL USE PERMIT, subject to certain conditions. Planning <br />Division staff suggests that the Council adopt a resolution approving the CONDITIONAL USE PERMIT. <br />City Code limits the size of an accessory structure to 864 square feet, but it allows for larger structures, up to <br />1,008 square feet, with a CUP. The Code requires the Planning Commission and City Council to consider the <br />following criteria when reviewing a CUP application: <br />a Impact on traffic; <br />b Impact on parks, streets, and other public facilities; <br />c Compatibility of the site plan, internal traffic circulation, landscaping, and structures with <br />contiguous properties; <br />d Impact of the use on the market value of contiguous properties; <br />e Impact on the general public health, safety, and welfare; and <br />f Compatility with the City's Comprehensive Plan <br />a-b The Planning Division has determined that the construction and use of the proposed detached <br />garage will not have an adverse impact on traffic in the neighborhood or on the City's parks, <br />streets, or other public facilities. <br />c [Attachment E] Despite the additional building, the site plan and internal traffic circulation <br />would remain largely unchanged. The proposed detached garage would still be about.�eet <br />from the adjacent property line to the south (and 65 feet from the residence on that property). <br />Furthermore, because the southern end of the proposed garage is 24 feet in length, which is <br />consistent with the size of an accessory building that could be permitted without a CUP, the <br />existing landscaping may be considered sufficient. <br />d [Attachment F] An accessory structure up to 864 square feet is permitted without the approval <br />of the Planning Commission or City Council; the proposal seeks to exceed this permitted size by <br />only 44 square feet. For this reason, and because the proposed exterior building treatment is to be <br />consistent with that of the principal structure, the Planning Division has determined that the <br />proposed use will not have an adverse impact on the market value of contiguous properties. <br />e The Planning Division believes that the proposed accessory building will have no impact on the <br />general public health, safety, and welfare. <br />f An accessory structure is a permitted use (and the proposed accessory building is a conditionally <br />permitted use) in the R-1 Single-Family Residence District and is compatible with the <br />Comprehensive Plan designation of Low-Density Residential. <br />Based on these comments and findings, the Planning Division, with the support of the Planning Commission, <br />recommends approval of the requested CONDITIONAL USE PERMIT to allow the construction of the <br />proposed accessory building, subject to the conditions identified in Section 7.1 of the staff report in your <br />packets. <br />
