The Planning Division has <br />determined that the allowance of the requested VARIANCE will not alter the <br />essential character of the locality, nor adversely affect the public health, safety, or <br />general welfare of the city or adjacent properties. <br />6.0 STAFF RECOMMENDATION: <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division recommends approval of Ms. Maylone's request for a VARIANCE to § 1004 <br />(Residential Districts) of the City Code to allow the construction of the proposed <br />residential addition, subject to the following conditions: <br />The proposed addition must not extend toward the front property line more than <br />22 feet from the existing building line. [Because the front property line and front <br />setback line both curve with the street, measuring 22 feet from the front of the <br />existing structure will be simpler than measuring 18.7 feet from a curved setback <br />line or even measuring 11 feet from a curved property line.] <br />b The variance shall expire within 6 months of the approval date if a building <br />permit is not issued far the respective site pursuant to § 1013.03 of the City Code. <br />7.0 SUGGESTED ACTION: <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 49 APPROVING A VARIANCE to <br />Section 1004.O1E (Pre-Existing Setbacks) to allow the construction of an attached <br />garage at 699 Belmont Lane in a location 11 feet from the front property line, which is <br />18.7 feet closer to the property line than Code permits, based on the comments and <br />findings of Section 5 and the conditions of Section 6 of the project report dated <br />December 6 2006. <br />8.0 NEXT STEPS: <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
