2.5 Staff has discussed the costs associated with preparing a Request for Council Action and other research pertaining to a variance appeal and the costs associated with preparing a mailed notice and has concluded that $150 for an appeal related to residential properties and $250 for an appeal related to commercial properties would be appropriate. 3.0 SUGGESTED PLANNING COMMISSION ACTION: 3.1 BY MOTION, RECOMMEND TO THE CITY COUNCIL THAT IT CONSIDER THE FOLLOWING ACTIONS: 3.2 AMEND CHAPTER 1014.04(C)(2) of the City Code to read: "The written appeal shall state the specific grounds upon which the appeal is made, and shall be accompanied by a fee established by resolution of the city council. A�e�g public meeting regarding the matter shall be held before the Board of Adjustment and Appeal at �� a regular meeting held within thirt�301 days of the receipt of the required written appeal. t��. A mailed notice of the public meetin� at which the appeal is to be considered shall be sent to members of the Variance Board and to all of those property owners who were provided notice of the action that is the subiect of the appeal being considered. 3.3 AMEND CHAPTER 1014.04(C) of the City Code to add subparagraph (3) stating: The Board of Adjustments and Appeals will reconsider onlv the evidence that had previously been considered at the Public Hearing at which the action that is the subject of the appeal was taken. New or additional information from the appeals a�plicant may be considered by the Board of Adjustments and A�peals at its sole discretion if that information serves to clarif�information previouslv considered at such Public Hearin�. 3.4 AMEND the City's Fee Schedule to require a Variance Appeal Filing Fee of $150 for an appeal related to residential properties and $250 for an appeal related to commercial properties.
