Amdt6_RCA_070813.doc <br />Page 2 of 4 <br />4.0B ACKGROUND 16 <br />As an outcome of many months of review and discussion, the City Council 17 <br />directed the Planning Division to create an additional Regional Business District 18 <br />in order to accommodate production and processing of materials and products on 19 <br />a limited basis. 20 <br />The proposal brought forward created the Regional Business-2 District (RB-2) in 21 <br />two specific locations: the first is west of Rosedale, along County Road B2 and 22 <br />Prior, and the second is adjacent to Long Lake Road, south of County Road C2 23 <br />(see attachment A). 24 <br />As Council Members may be aware, the request by the Planning Division seeks to 25 <br />clarify when production of goods as a principal use on a limited basis is 26 <br />permissible within the Regional Business District, which provides some certainty 27 <br />for pre-existing non-conformities. Roseville is full of nondescript businesses that 28 <br />have production and processing as a component of their “use,” which has added 29 <br />to the challenge of providing clarity.30 <br />As the City Planner delved deeper into his research and potential solutions, 31 <br />similarities kept popping up. Take, for instance, Edible Arrangements, where 32 <br />there is processing and production of edible fruit arrangements that are packaged 33 <br />and mailed, delivered, or picked-up at their Lexington/Larpenteur store. Or 34 <br />Byerly’s, with the catering business that produces cakes and other food items and 35 <br />then delivers the mass-produced goods via a small fleet of vehicles. Or an un-36 <br />named tailor shop that offers shirts, jackets, and/or sweatshirts mass-produced 37 <br />and/or processed on-site for pick-up or delivery. These three businesses and their 38 <br />production/processing uses are not much different (on the surface) than Fastenal 39 <br />or Sarah Lee or Fantasy Flight or UV Color, except where the production and/or 40 <br />processing component can be determined to be principal or primary versus 41 <br />accessory or ancillary; making such determinations is not always an easy task. 42 <br />Therefore, clearly understanding these differences and developing definitions to 43 <br />effectively separate the ancillary/accessory from the primary/principal is 44 <br />necessary to properly address that which the City Council seeks and to limit or 45 <br />minimize further expansion of the primary/principal use into unintended areas of 46 <br />Roseville.47 <br />5.0P ROPOSAL 48 <br />Based on discussions with the City Council it was determined that the former 49 <br />light industrial area/parcels west of Fairview Avenue along portions of County 50 <br />Road B2 and Prior Avenue would be appropriate for the new RB-2 District. The 51 <br />Planning Division also identified the area south of County Road C2 and west of 52 <br />Long Lake Road as another area that could support limited production and 53 <br />processing as a primary/principal use (see attached mapped areas). 54 <br />Further, working with the City Attorney, the City Planner has developed the 55 <br />following definitions for consideration, which will amend Section 1001.10 56 <br />Definitions of the Zoning Ordinance:57
