Document# 1985385 <br />Certified Filed On 11/13120061600 <br />Registrar of Titles, Ramsey County, MN <br />Certificate# 530059 <br />5.2.3 173196F <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF TAE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 25`h day of September, 2006, at 6:00 <br />p.m. <br />The following members were present: Mayor Klausing and Members Ihlan, Kough, <br />Maschka, and Pust; and none were absent; <br />Council Member Maschka introduced the following resolution and moved its adoption: <br />RESOLUTION N0.10435 <br />A RESOLUTION APPROVING THE VACATION OF THE SANITARY SEWER <br />EASEMENT ON CERTAIN UNDEVELOPED RESIDENTIAL LOTS (PF37S9) <br />WHEREAS, J.W. Moore, Inc. and Keller-Williams Realty have requested the vacation of <br />the above-referenced sanitary sewer easement; and <br />WHEREAS, the easement is currently located on the property that is legally described as: <br />LOTS 14 THROUGH 19, BLOCK 4, RULLING GREEN <br />PIN: 13-29-23-31-0079 and 00$0 and <br />PIN: 13-29-23-32 0002 through 0005 <br />WHEREAS, the Public Works Department has determined that the easement subject to <br />the request may be vacated if the existing sanitary sewer main is appropriately relocated, rebuilt, <br />and protected by a new easement; and <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the <br />Sanitary Sewer Easement Vacation requested by the applicants and voted (5-0) to recommend <br />approval of the vacation, based on the findings of Section 5 of the Planning Commission project <br />report dated September 6, 2006 and the conditions as amended by the Planning Commission and <br />written in Section 7.2 of the City Council project report dated September 25, 2006; <br />1 of 3 <br />
