• <br />REQUEST FOR VARIANCE BOARD ACTION <br />DATE: OS/2/06 <br />ITEM NO: 4a <br />Department Approval: <br />BL/TRP <br />Agenda Section: <br />PUBLIC HEARINGS <br />Item Description: Croix Oil Co. seeks VARIANCES to §1005 (Business Districts) and <br />§1012 (General Requirements) to allow the replacement of the existing <br />pylon signs in non-conforming locations at two business sites (PF3783). <br />1.0 REQUESTED ACTION: <br />1.1 Croix Oil Company seeks variances to § 1005 (Business Districts) and § 1012 (General <br />Requirements) of the City Code to allow the replacement of a pylon sign at 3110 <br />Cleveland Avenue at a distance of 10 feet from the County Road D property line and 8 <br />feet from the Cleveland Avenue properiy line, and the replacement of a pylon sign at <br />2151 Dale Street at a distance of 5 feet from both the County Road B and Dale Street <br />rights-of-way. <br />PROJECT REVIEW HISTORY <br />• Application submitted and determined complete: July 6, 2006. <br />• Sixty-day review deadline: September 4, 2006. <br />• • Project report recommendation: August 2, 2006. <br />• Anticipated Variance Board action: August 2, 2006. <br />• <br />2.0 SUMMARY OF RECOMMENDATION: <br />2.1 The Planning Division recommends approval of VARIANCES to § 1005 (Business <br />Districts) and § 1012 (General Requirements) for both of the proposed sites. See Section 6 <br />of this report for detailed recommendation. <br />3.0 SUGGESTED ACTION: <br />3.1 ADOPT A RESOLUTION APPROVING A VARIANCE to Section 1012.03 <br />(General Requirements) to allow a pylon sign within the "visibility triangle" and a <br />VARIANCE to Section 1005.01 (Business Districts) to allow the construction of a <br />pylon sign in a location 22 feet closer to the Cleveland Avenue property line and 20 <br />feet closer to the Count Road D property line than Code permits; see Section 7 below <br />for detailed action. <br />3.2 ADOPT A RESOLUTION APPROVING A VARIANCE to Section 1012.03 <br />(General Requirements) to allow a pylon sign within the "visibility triangle" and a <br />VARIANCE to Section 1005.01 (Business Districts) to allow the construction of a <br />pylon sign in a location 25 feet closer to the Dale Street right-of-way and 25 feet <br />closer to the Count Road B right-of-way than Code permits; see Section 7 below for <br />detailed action. <br />PF3783_RVBA_080206 <br />Page 1 of 5 <br />
