j�� <br />� <br />18 August 2006 <br />Richard & Jeanne Podvin <br />698 Terrace Drive <br />Roseville, MN 55113 <br />RE: Side Yard Setback Permit approval for 698 Terrace Drive <br />Dear Mr. and Mrs. Podvin, <br />On Thursday, August 17t", 2006, the Roseville Development Review Committee reviewed and <br />recommended approval of a SIDE YARD SETBACK PERMIT to construct a 12-foot by 24- <br />foot garage addition which will encroach into the required side yard setback. <br />Comments Re�ardin� Issues at Hand: The applicants reviewed their plans with the immediate <br />neighbors, most of which signed prepared statements that they have no objections to the approval <br />of the requested setback permit. The remaining two neighbors (2731 St. Albans Street and 693 <br />Terrace Drive) were either unavailable or have offered no comment. <br />Development Review Committee Recommendation: The Setback Permit Review Committee <br />attendees (Bryan Lloyd, Don Munson, and Jamie Radel) found that the proposal does satisfy <br />more than eight of the twelve applicable criteria for approving a Setback Permit as listed in <br />§ 1013.05 of the City Code. The DRC therefore recommended issuance of the Setback Permit, <br />with the additional conditions as follows: <br />1. The driveway must not exceed 26 feet in width at the front property line; the driveway <br />may be flared to the desired width inside the property line, provided that it does not <br />come within 5 feet of the side property line (as required in § 1004.016 of the City Code). <br />2. No rain gutters will be required unless storm water runoff from the site becomes a <br />problem for the neighbor adjacent to the garage addition. If such a problem is brought to <br />the attention of the City, gutters will then be required which direct rain water runoff into <br />the front or rear yards and not toward the adj acent property. <br />While not a condition for approval of the Setback Permit, it was pointed out that the side lot line <br />adjacent to the garage addition must be clearly identified for a preconstruction inspection so that <br />the distance between the proposed addition and the side property line can be verified. <br />Community Development Director's Decision: I concur with the recommendations of the <br />DRC to issue the Setback Permit and, as allowed for in §1013.05 of the City Code, make the <br />DRC recommendations a condition of approval. <br />The Setback Permit will become effective after the (ten-day) appeal period has expired at NOON <br />on Monday, August 28t", assuming no written appeal has been received by the City Manager.
