Thomas McDaniel <br />Roseville City Council Meeting <br />Page 3 <br />Mitigation <br />The area being discussed is now utilized as a storm water drainage and retention area. <br />Storm water is channeled to the azea from many points in the surrounding neighborhood. It <br />is recognized that while the azea was not historically a"wetland", it has some wetland type <br />characteristics (soils, vegetation, hydrology) - which of course have significantly expanded <br />due to the storm water. <br />The proposed addition to the McDaniel home is about 75 feet from the wetland noted on the <br />Certificate of Survey, well outside the 50 foot setback requirement. The proposed addition <br />is about 35 feet from tt�►e existing storm water retention boundary. <br />With a variance being granted, the McDaniel's are willing to mitigate any potential quality <br />issues to the storm water retention area. The mitigation would include bank stabilization to <br />prevent erosion and filtration vegetation. This would result in a net increase in the <br />functional benefits of wetland protection in this area. The McDaniel's have already <br />contracted a qualified ecological firm to perform a baseline MinRAM assessment (quality <br />assessment) on the area. Another MinRAM assessment could be performed in the future to <br />confirm mitigation plan effectiveness. <br />Summary <br />• The Certificate of Survey is the legally binding document for determining property <br />boundaries and setbacks. <br />� The proposed addition is about 75 feet from the wetland indicated on the Certificate <br />of Survey. <br />• The Schoell Madson drawing, with the enlarged wetland azea, was generated in Feb, <br />1995. The Certificate of Survey was generated in Nov, 1996. The enlarged wetland <br />could have been included in Certificate of Survey. However, it was not. <br />• The McDaniel's would have absolutely not selected the lot at 527 Owasso Hills if <br />the enlarged wetland was a known limitation. <br />• The area was not historically a wetland. To this day it is not registered as a wetland <br />at the State or Federallevel. <br />• The McDaniel's are willing to implement a mitigation plan to increase the functional <br />benefits of wetland protection in the area being discussed. <br />I look forward to the Feb 26 City Council meeting.
