February 19, 2007
To: The City of Roseville
Attn: Mr Bryan Lloyd, Associate City Planner
2660 Civic Center Dr
Roseville, MN 55113
Dear Mr Lloyd -
This letter and the attached documents aze in preparation for the Feb 26, 2007 Roseville City
Council meeting. Thomas McDaniel originally filed an appeal to a Variance Boazd decision,
which was presented and reviewed at the Oct 23, 2006 City Council meeting. At the Oct 23
meeting, the Council decision was to grant a continuation to further clarify the conflicting data
that was presented at that time.
The points below will hopefully clarify the somewhat complicated situation.
Original Property Situation
T'he McDaniel's purchased the lot at 527 Owasso Hills Dr in 1996. At this time the outlot
area behind the building area consisted of two distinct ponds and a"wetland" area. The two
ponds were specifically constructed when the neighborhood was developed for storm water
retention. The "wetland" azea between the ponds was partially on our property. We were
properly informed that the wetland existed on the property and of the 50 foot setback
requirement. In fact, when the property was purchased, a form was signed to document the
acknowledgement of the wetland and the 50 foot setback requirements.
Original Wetland Boundary
There were two drawings presented to the McDaniel's during the lot purchase and home
build processes which documented the borders of the property and the wetland location.
One was the platt drawing used by the Developer (and all three builders) within the Owasso
Hills neighborhood. The other was the formal Certificate of Survey for the property at 527
Owasso Hills. These two drawings (attached) are consistent in terms of delineating the
original wetland boundary in the northwest corner of the 527 property. According to these
two drawings, the closest wetland boundary would be at least 75 feet from the proposed 250
sq ft addition to the existing home.
Roseville City Staff presented another drawing showing the wetland boundary (attached).
This version is v inconsistent with the other two documents mentioned and shows a much
larger wetland. This drawing was generated by an architectural firm (Schoell Madson) in
1995. Per the Schoell Madson drawing, the wetland area is so large that the existing home
at 527 Owasso Hills is basically right up against the 50 foot setback.
So, as highlighted in the Oct 23, 2006 City Council meeting, there remains conflicting data
relative to the original "wetland" boundary.
