Attachment J: <br />Draft Concurring Resolution <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CIT'Y COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 23`d day of October, 2006, at 6:00 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION DENYING A VARIANCE TO �1016.16 AND IN ACCORDANCE <br />WITH �1013.02 OF THE ROSEVILLE CITY CODE FOR THOMAS MCDANIEL AT 527 <br />OWASSO HILLS DRIVE (PF3787) <br />WHEREAS, Thomas McDaniel is the owner of property at 527 Owasso Hills Drive; and <br />WHEREAS, the subject property is legally described as: <br />OWASSO HILLS LOT 10, BLOCK 1 <br />PIN: 01-29-23-32-0026 <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to § 1016.16 (Wetland <br />Setbacks) to allow principal structure encroachment into the required wetland setback; and <br />WHEREAS, The Roseville Variance Board held a public hearing regarding the requested <br />VARIANCE, voting 3-0 to DENY based on their determination that "hardships" were not <br />present; and <br />WHEREAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council seeking the Council's support for the requested 15-foot setback <br />VARIANCE; <br />WHEREAS, the Roseville City Council concurs with the resolution passed by the <br />Variance Board, determining the following finding of fact: <br />WHEREAS, Section 1016.16 requires a minimum 50-foot setback for principal <br />residential structures from wetland boundaries; and <br />WHEREAS, Thomas McDaniel seeks to expand the principal residential structure to <br />encroach into the required wetland setback; and <br />WHEREAS, the Planning Division has concluded that "hardships" are NOT present and <br />support CANNOT be given to deviate from the strict requirements of the Roseville City Code; <br />
