Attachment J: Draft Concurring Resolution EXTRACT OF MINUTES OF MEETING OF THE CIT'Y COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 23`d day of October, 2006, at 6:00 p.m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION DENYING A VARIANCE TO �1016.16 AND IN ACCORDANCE WITH �1013.02 OF THE ROSEVILLE CITY CODE FOR THOMAS MCDANIEL AT 527 OWASSO HILLS DRIVE (PF3787) WHEREAS, Thomas McDaniel is the owner of property at 527 Owasso Hills Drive; and WHEREAS, the subject property is legally described as: OWASSO HILLS LOT 10, BLOCK 1 PIN: 01-29-23-32-0026 WHEREAS, the property owner seeks a 15 foot VARIANCE to § 1016.16 (Wetland Setbacks) to allow principal structure encroachment into the required wetland setback; and WHEREAS, The Roseville Variance Board held a public hearing regarding the requested VARIANCE, voting 3-0 to DENY based on their determination that "hardships" were not present; and WHEREAS, the applicant has appealed the decision of the Variance Board to the Roseville City Council seeking the Council's support for the requested 15-foot setback VARIANCE; WHEREAS, the Roseville City Council concurs with the resolution passed by the Variance Board, determining the following finding of fact: WHEREAS, Section 1016.16 requires a minimum 50-foot setback for principal residential structures from wetland boundaries; and WHEREAS, Thomas McDaniel seeks to expand the principal residential structure to encroach into the required wetland setback; and WHEREAS, the Planning Division has concluded that "hardships" are NOT present and support CANNOT be given to deviate from the strict requirements of the Roseville City Code;
