Attachment E: Draft Variance Approval Resolution <br />EXTRACT OF MINUTES OF MEETING OF THE <br />C[TY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 26`�' day of February, 2007, at 6:00 <br />p.m. <br />The following meinbers were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A VARIANCE TO §1016.16 IN ACCORDANCE WITH <br />§1013.02 OF THE ROSEVILLE CITY CODE FOR THOMAS 1�1CDANIEL AT 527 <br />OWASSO HILLS DR1VE (PF3787) <br />WHEREAS, Thomas McDaniel is the owner of property at 527 Owasso Hills Drive; and <br />WHEREAS, the subject property is legally described as: <br />OWASSO HILLS LOT 10, BLOCK 1 <br />PIN: 01-29-23-32-0026 <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to § 1016.16 (Wetland <br />Setbacks) to allow principal structure encroachment into the required wetland setback; and <br />WHEREAS, The Roseville Variance Board held a public hearing regarding the requested <br />VARIANCE, voting 3-0 to DENY based on their determination that "hardships" were not <br />present; and <br />WHEREAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council seeking the Council's support for the requested 15-foot setback <br />VARIANCE; <br />WHEREAS, the Roseville City Council has determined that the circumstances on the <br />property are unique and not of the property owner's own making, and that hardships will result <br />from strict application of the Roseville City Code, and that granting the requested variance will <br />not adversely affect the health, safety, and general welfare of the Citizens of Roseville; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Thomas McDaniel for a 15-foot VARIANCE to § 1016.16 (Wetland Setbacks) in <br />accordance with § 1013.02 of the Roseville City Code, subject to the following conditions: <br />1. The encroachment must be limited to 35 feet from the wetland boundary <br />delineated on the May 1995 Storm Sewer As-built drawings on file with the City. <br />
