Attachment E: Draft Variance Approval Resolution EXTRACT OF MINUTES OF MEETING OF THE C[TY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 26`�' day of February, 2007, at 6:00 p.m. The following meinbers were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION APPROVING A VARIANCE TO §1016.16 IN ACCORDANCE WITH §1013.02 OF THE ROSEVILLE CITY CODE FOR THOMAS 1�1CDANIEL AT 527 OWASSO HILLS DR1VE (PF3787) WHEREAS, Thomas McDaniel is the owner of property at 527 Owasso Hills Drive; and WHEREAS, the subject property is legally described as: OWASSO HILLS LOT 10, BLOCK 1 PIN: 01-29-23-32-0026 WHEREAS, the property owner seeks a 15 foot VARIANCE to § 1016.16 (Wetland Setbacks) to allow principal structure encroachment into the required wetland setback; and WHEREAS, The Roseville Variance Board held a public hearing regarding the requested VARIANCE, voting 3-0 to DENY based on their determination that "hardships" were not present; and WHEREAS, the applicant has appealed the decision of the Variance Board to the Roseville City Council seeking the Council's support for the requested 15-foot setback VARIANCE; WHEREAS, the Roseville City Council has determined that the circumstances on the property are unique and not of the property owner's own making, and that hardships will result from strict application of the Roseville City Code, and that granting the requested variance will not adversely affect the health, safety, and general welfare of the Citizens of Roseville; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE the request by Thomas McDaniel for a 15-foot VARIANCE to § 1016.16 (Wetland Setbacks) in accordance with § 1013.02 of the Roseville City Code, subject to the following conditions: 1. The encroachment must be limited to 35 feet from the wetland boundary delineated on the May 1995 Storm Sewer As-built drawings on file with the City.
