PLANNING FILE 3791 <br />Art Mueller seeks approval <br />residential property at 2201 <br />street. <br />of a PRELIMINARY PLAT for the proposed subdivision of the <br />Acorn Road into four (4) single-family lots served by a public <br />Chair Traynor opened the Public Hearing at for Planning File 3791. <br />City Planner Thomas Paschke reviewed the request of Mr. Mueller to subdivide his 1.9 acre <br />parcel into four (4) single-family residential lots served by a public street and public utilities. <br />Mr. Paschke noted that the proposal complies with all code requirements, and does not <br />require Comprehensive Land Use Map designation amendment or a rezoning. <br />Chair Traynor reviewed the previous case before the Commission for a Planned Unit <br />Development (PUD), with a private street, and requested that staff explain the difference in <br />that and this request. <br />City Planner Paschke briefly reviewed the request and explained that the previous PUD was <br />for a private street versus the public street now proposed; and noted that staff had not <br />determined that no portion of tonighYs request was not in compliance with current City code. <br />City Attorney Langel concurred with the previous discussion points. <br />Commissioner Wozniak opined that the PUD allowed for more input from the City toward the <br />development of the lots as opposed to the proposed plat at tonighYs meeting. <br />Mr. Paschke advised that with the proposed Preliminary Plat meeting all current code <br />requirements, the City's ability to place conditions on the development were limited (i.e., tree <br />preservation; lot size modifications), and would not allow for modifying setbacks or <br />Applicant, Art Mueller, was present, but had no comment at this time. <br />Staff recommended approval of the PRELIMINARY PLAT for Art Mueller, creating four (4) <br />legal, conforming residential lots and a public cul-de-sac street on the 1.9 acre parcel at 2201 <br />Acorn Road, as conditioned in the staff report dated November 1, 2006. <br />Commissioner poherty left the meeting at this time to attend another scheduled <br />meeting. <br />Public Comment <br />Joel Cheney, 2172 Acorn Road <br />Mr. Cheney had numerous questions on setbacks; similar and recent development in the <br />same neighborhood; determination of front setback requirements; and his concerns regarding <br />those setback requirements and drainage issues. <br />Mr. Paschke addressed several of Mr. Cheney's concerns, as well as misconceptions <br />regarding the proposed Preliminary Plat for 2201 Acorn Road. Mr. Paschke advised that <br />placement of a home on a lot determined what was the frontage of the lot, and on which <br />street it became addressed to, noting that the rear or side yard setbacks had yet to be <br />identified, depending on the development and building permitting processes and when <br />individual plans and documentation were submitted; and clarified that the Planning <br />Commission was considering the creation of four (4), legal, conforming residential lots and a <br />public cul-de-sac street on the 1.9 acre parcel at 2201 Acorn Road. Mr. Paschke advised <br />that staff had yet to review final utility and drainage plans, but noted that those reviews and <br />approvals would be part of the permitting process, as dictated by code and administered by <br />staff. <br />Mr. Cheney had additional comments specific to recent development of his qropertv and <br />
