.. <br />� <br />5.11 The pli�ht of the landowner is due to circumstances unique to the property not <br />created bv the landowner: The steepness of the slope (and the dangerous conditions <br />created when the driveway is snowy or icy) is unique to this area of Roseville and not a <br />circumstance created by the property owners. While these circumstances have existed <br />since the property was developed (and arguably met with the applicants' approval when <br />they purchased the property), allowing the proposed improvements would eliminate the <br />slope, which would otherwise remain dangerous to the applicants, future property owners, <br />and the public. The Planning Division has determined that the plight of the <br />landowner is due to unique circumstances not created by the landowner. <br />5.12 The variance, if granted, will not alter the essential character of the locality: The <br />houses surrounding the subject properiy range in size from about 825 square feet to about <br />2,225 square feet. Based on rough calculations, the proposed addition would increase the <br />livable area of this house to about 2,100 square feet. And although no other houses in the <br />area rise 3 stories from South McCarrons Blvd., much of the proposed addition will <br />remain underground and its roofline will continue to be well below the peaks of the <br />adjacent houses. The Planning Division has determined that the allowance of the <br />requested VARIANCE will not alter the essential character of the locality, nor <br />adversely affect the public health, safety, or general welfare of the city or adjacent <br />properties. <br />6.0 STAFF RECOMMENDATION: <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division recommends approval of the Trans' request for a VARIANCE to § 1004 <br />(Residential Districts) of the City Code to allow the construction of the proposed <br />residential addition. <br />7.0 SUGGESTED ACTION: <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 46 APPROVING A VARIANCE to <br />Section 1004.O1E (Pre-Existing Setbacks) to allow the construction of a residential <br />addition and tuck-under garage at 296 South McCarrons Boulevard in a location 14 <br />feet from the front property line, which is 26 feet closer to the property line than <br />Code permits, based on the comments and findings of Section 5 of the project report <br />dated November 1, 2006. <br />8.0 NEXT STEPS: <br />8.1 The decision of the Variance Board is final unless an appeal is filed. The appeal period <br />remains open for 10 days from the date of the decision, and an appeal may be made either <br />by the applicant or by another Roseville property owner. <br />8.2 An appeal must be submitted in writing to the City Manager by NOON on November <br />13`�', 2006 for a hearing before the City Council on Monday, November 20th, 2006. <br />8.3 If no appeal is filed, a building permit may then be issued, and Community Development <br />staff will mail the resolution approving the variance to Ramsey County for recording <br />against the subject property. <br />PF3794_RVBA_110106 <br />Page 4 of 5 <br />
