EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL CITY OF ROSEVILLE RAMSEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, Minnesota was duly held at the City Hall in said City on Monday, the twenty-third day of August, 1999, at 6:30 p.m. The following members were present: Wiski, Mastel, Goedeke, Maschka and Wall and the following were absent: none. Councilperson Goedeke introduced and moved the adoption of the following resolution: RESOLUTION NO. 9677 RESOLUTION DETERMINING TO ACQUIRE BY CONDEMNATION UNDER THE POWERS OF EMINENT DOMAIN CERTAIN EASEMENTS FOR PATHWAY PURPOSES, AND TEMPORARY CONSTRUCTION, AND DIRECTING THE NECESSARY PROCEEDINGS BE INSTITUTED BY THE CITY ATTORNEY FOR SUCH PURPOSE WHEREAS, the City Council for the City ofRoseville has approved a project to acquire certain property by reason of construction of a multi-use pathway, said improvement identified by City records as Improvement No. 98-11; and WHEREAS, the City Council has been advised by competent advisers that the following described real property is necessary for the construction of the pathway; and WHEREAS, the City has been unable to agree on a negotiated amount for some of the easements to be acquired; and WHEREAS, under Minnesota Statute 412.211 and Minnesota Statute Chapter 117, the City has the power to take and acquire easements by way of eminent domain; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEVILLE, MINNESOTA, AS FOLLOWS: The City Council of the City of Roseville hereby deems it necessary and convenient that permanent and temporary construction easements on the properties described in the attached Exhibit A be acquired by the City ofRoseville for the purposes above described.
