<br />WHEREAS, the Roseville City Council made the following findings: <br /> <br />1 Section 1004.02D requires a minimum front yard setback of 30 feet. Given how the home is <br />situated on the lot (facing southwest), Alta Vista Drive is the corner side yard of the <br />property. The City Code requires corner side yards to have the same setback as a front <br />yard or a minimum of 30 feet. <br /> <br />2 The existing home was constructed in 1941, prior to the establishment of the City of <br />Roseville, and lies 14.5 feet from the property line adjacent to Alta Vista Drive. <br /> <br />3 In 1986 Alta Vista Drive was reconstructed and the City purchased an additional five (5) <br />feet of property from all residents along Alta Vista Drive, thus reducing the front yard area <br />from 19.5 feet to 14.5 feet. <br /> <br />4 A variance requires the applicant to prove physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance. <br /> <br />5 The property has two retaining walls to accommodate the unique elevation change on the <br />lot. The first is located along Alta Vista and was constructed as a component of the <br />roadway reconstruction. The second retaining wall is located in the side yard adjacent to <br />the home and Dale Street. <br /> <br />6 A small rear/side yard (north & east) exists on the north side of the lot and home. Because <br />this is the only flat area on the lot it is the location for a play area. <br /> <br />7 The proposed step and porch addition, though encroaching to a point 8.6 feet and 10 feet <br />respectively from the Alta Vista Drive property line, would provide an architectural design <br />and living area that would not be afforded to the homeowners unless placed on the north <br />side of the home and within the play area. <br /> <br />8 The limited flat area on the lot, the unique shape of the lot, the lot's double frontage, and <br />the date the home was constructed, are all pre-existing hardships for this property that <br />afford no alternative other than a variance. <br /> <br />9 The variance, if granted, will not adversely affect the public health, safety, or general <br />welfare of the citizens of Roseville. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") of the City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that a variance to reduce the front <br />yard setback from 30 feet to eight (8) feet six (6) inches for the purpose of allowing construction <br />of a porch on the west and south side of the existing home at 1810 Alta Vista Drive (PID # <br />142923410079) be approved. <br /> <br />Page 2of3 <br />
