ORDINANCE NO. 1357 <br />AN ORDINANCE AMENDING TITLE 1, 10 AND 11 OF THE CITY CODE, <br />CHANGING THE PUBLIC HEARING NOTIFICATION DISTANCE FROM A <br />MINIMUM OF 350 FEET TO A MINIMUM 500 FEET. <br />The City Council of the City of Roseville does ordain: <br />Section l. Purpose. The Roseville City Code, Tile 1, 10, and 11 is hereby <br />amended by eliminating the minimum public hearing notification mailing distance from <br />350 feet to a minimum of 500 feet for all land use applications (Planned Unit <br />developments, Conditional Use, Rezoning, Variance, Comprehensive Plan Amendment, <br />Land Division, Easement/Right-of-Way Vacation). <br />SECTION 2. The following Chapters are hereby amended as follows: <br />108.O1B Procedures for Conducting Certain Public Hearings — Notice <br />Notice of the time and place of such hearing shall be published in the designated <br />legal newspaper no less than ten (10) nor more than thirty (30) days prior to the <br />hearing. In the event the hearing involves a particular parcel of land, mailed <br />notice shall be given by the City to the owner and each of the property owners <br />within 500 feet of the outside boundaries of the parcel and to State, County, and <br />Federal agencies, if applicable. Failure to mail notice or failure of the property <br />owner to receive the notice shall not invalidate the proceedings. <br />1013.O1C Conditional Use Permits — Procedure for Conditional Use Permit <br />Any owner of land may file an application for a conditional use permit by paying <br />the amount set forth in section 1014.03 of this title, providing a complete <br />application and supporting documents as set forth in the standard community <br />development department application form, and by providing the city with an <br />abstractor's certified property certificate showing the property owners within 500 <br />feet of the outer boundary of the parcel of land on which the conditional use <br />permit is requested. A hearing shall be held on the application by the planning <br />commission, with notice and hearing procedure as set forth in chapter 108 of this <br />code except that the notices shall contain the description of the land and the kind <br />of conditional use permit involved.
