4.0 REVIEW OF REQUEST <br />, 4.1 Both of the parcels have a zoning designation of R-1, Single-Family Residence District <br />and a Comprehensive Land Use Plan designation of LR, Low Density Residential. <br />4.2 The proposed property boundary change would not affect the overall area of either parcel. <br />, 5.0 STAFF COMMENTS <br />5.1 City Code § 1104.04B (Recombination) allows the transfer of property from one parcel to <br />an abutting parcel upon the approval of the City Council. No public hearing is required <br />provided that the proposed recombination does not cause any nonconforming condition <br />on the properties involved. <br />� i 5.2 The proposed recombination would not create any new nonconforming conditions nor <br />i' exacerbate any existing nonconformities. On the contrary, the proposed realignment of <br />�' the common property boundary would achieve the required principal structure setback at <br />�:_ 410 S McCarrons Boulevard. <br />� 5.3 If approved, the proposed recombination would have no effect on the surrounding <br />� properties. <br />i: 5.4 Drainage easements consistent with Code requirements are not indicated on the survey <br />� but should be included on the final survey. <br />� 6.0 STAFF RECOMMENDATION <br />� 6.1 Based on the comments and findings outlined in Sections 4 and 5 of this report, the <br />, Planning Division recommends approval of the requested RECOMBINATION MINOR <br />� SUBDNISION to allow the proposed realignment of the property boundary common to <br />, 410 and 414 South McCarrons Boulevard, subject to the following conditions: <br />� a. Drainage easements consistent with Code requirements must be dedicated on both <br />, . parcels; and <br />. b. Within thirty (30) days after approval by the City Council, the applicant shall <br />� t supply the final survey to the Community Development Director for review and <br />;� % approval. A certificate of survey shall be required on all proposed parcels. After <br />< completion of the review and approval by the City Manager, the survey shall be <br />, recorded by the applicant with the Ramsey County Recorder within sixty (60) <br />3c days. <br />� 7.0 SUGGESTED ACTION <br />.. 7.1 BY MOTION, APPROVE THE REQUESTED RECOMBINATION MINOR <br />SUBDIVISION for Kevin McGrath and Bobbie Jo Carpenter to allow the proposed <br />._ realignment of the property boundary common to 410 and 414 South McCarrons <br />,.
