� 4.0 <br />2 4.1 <br />J <br />4 4.2 <br />J S.O <br />—. <br />0 <br />REVIEW OF REQUEST <br />Both of the parcels have a zoning designation of R-1, Single-Family Residence District <br />and a Comprehensive Land Use Plan designation of LR, Low Density Residential. <br />The proposed property boundary change would not affect the overall area of either parcel. <br />STAFF COMMENTS <br />6 5.1 City Code § 1104.04B (Recombination) allows the transfer of property from one parcel to <br />% an abutting parcel upon the approval of the City Council. No public hearing is required <br />8 provided that the proposed recombination does not cause any nonconforming condition <br />9 on the properties involved. <br />� 0 5.2 The proposed recombination would not create any new nonconforming conditions nor <br />17 exacerbate any existing nonconformities. On the contrary, the proposed realignment of <br />12 the common property boundary would achieve the required principal structure setback at <br />13 410 S McCarrons Boulevard. <br />� � 5.3 <br />15 <br />16 5.4 <br />17 <br />� 8 6.0 <br />If approved, the proposed recombination would have no effect on the surrounding <br />properties. <br />Drainage easements consistent with Code requirements are not indicated on the survey <br />but should be included on the final survey. <br />STAFF RECOMMENDATION <br />19 6.1 Based on the comments and findings outlined in Sections 4 and 5 of this report, the <br />2C Planning Division recommends approval of the requested RECOMBINATION MINOR <br />2 � SUBDIVISION to allow the proposed realignment of the property boundary common to <br />22 410 and 414 South McCarrons Boulevard, subject to the following conditions: <br />23 a. Drainage easements consistent with Code requirements must be dedicated on both <br />24 parcels; and <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />3 � 7.0 <br />b. Within thirty (30) days after approval by the City Council, the applicant shall <br />supply the final survey to the Community Development Director for review and <br />approval. A certificate of survey shall be required on all proposed parcels.
