�"� <br />� <br />1` <br />REQUEST FOR PLANNING COMMISSION ACTION <br />DATE: 12/16/2009 <br />ITEM NO: Sa <br />Div�for� Approval: <br />Agenda Section: <br />PUBLIC HEARINGS <br />Item Description: Request by Reco Real Estate, LLC for approval of outdoor storage as an <br />INTERIM USE at 1705 County Road C(PF09-025) <br />1.O REQUESTED ACTION <br />RECO Real Estate, LLC is requesting approval of the outdoor storage of boats at <br />Boater's Outlet, 1705 County Road C, as an INTERIM USE, pursuant to § 1013.09 (Interim <br />Uses) of the City Code, in order to continue legally operating the existing business. <br />Proj�ct Review History <br />• Application submitted: November 19; determined complete; December 3, 2009 <br />• Sixty-day review deadline: January 18, 2009 <br />• Project report prepared: December 9, 2009 <br />• Anticipated Planning Commission action: December 16, 2009 <br />• Anticipated City Council action: December 21, 2009 <br />2.0 SUMMARY OF STAFF RECOMMENDATION <br />The Planning Division recommends approval of the proposed �NTER�1vt vSE, subject to <br />certain conditions; see Section 7 of this report for detailed recommendation. <br />3.0 <br />4.0 <br />SUMMARY OF SUGGESTED ACTION <br />By motion, recommend approval of the proposed nvTER��vt usE, pursuant to § 1013.09 <br />(Interim Uses) of the City Code, subject to conditions; see Section 8 of this report for <br />detailed action. <br />BACKGROUND <br />4.1 In 2004, Roseville's City Council enacted a moratorium on new outdoor storage uses in <br />the Twin Lakes redevelopment area, which included the subject property. Although the <br />moratorium did not specifically target such uses on this property, 1705 County Road C <br />fell within the redevelopment area; consequently, the property owners could not apply for <br />the permanent conditional use approval. Instead, the only option for allowing the outdoor <br />storage of boats in this location was to approve it temporarily with an Interim Use Permit. <br />The moratorium has since been rescinded. <br />42 While the approved Interim Use Permit expired in 2007, Boater's Outlet has continued to <br />operate without incident until today. Planning Division staff has been aware of the fact <br />that the outdoor storage of boats has been a nonconforming use since 2007, but has not <br />had the opportunity until recently to remind the property owners that the previous <br />approval was, by nature, temporary and that they needed to receive permanent (i.e., a <br />PF09-025 RPCA 121609 <br />Page 1 of 3 <br />
