--� � <br />5.7 The plight of the landowner is due to circumstances unique to the pro�erty not created by <br />the landowner: Substandard lots are not "unique" in Roseville, but they do present real <br />challenges in light of the requirements of the City Code. The subject property was platted <br />and improved about 6 years before the City had a Zoning Ordinance, at a time when <br />property owners could not anticipate the zoning regulations that would restrict further <br />improvements to the property; the Planning Division has therefore determined that the <br />plight of the landowner is due to circumstances not created by the landowner. <br />5.8 The variance, if granted, will not alter the essential character of the localit� While most <br />houses in the area appear to have front yard setbacks equal to or greater than the subject <br />property, a front porch as is proposed would reinforce the residential character of the <br />area. An indication that Planning Division staff supports this kind of improvement as <br />being appropriate in residential neighborhoods is in the fact that the proposed draft of the <br />new single-family zoning district includes a provision designed to permit open porches <br />that extend as close as 22 feet from the front property line without requiring special <br />approvals. <br />6.O STAFF RECOMMENDATION <br />Based on the comments and findings outlined in Section 5 of this report, Planning <br />Division staff recommends approval of a vAR�AtvcE to the front yard setback requirement <br />established in § 1004.016 of the City Code to allow the proposed open front porch at 1830 <br />Oxford Street, with the following condition: <br />The proposed addition shall be consistent in size and location with the site plan <br />included with this staff report as Attachment D. <br />7.0 SUGGESTED ACTION <br />ADOPT VARIANCE BOARD RESOLUTION 87 approving a VARIANCE to Section 1004 of the <br />City Code that would allow the construction of the proposed porch, based on the <br />comments and findings of Section 5 and the condition of Section 6 of this report. <br />H.O NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
