-. <br />Attachment B <br />of materials other than normal office supplies. <br />(5) Finally, the land use renders services that aze essentially public. <br />A determination that a land use is a"low impact quasi-public use" must meel the five (5) above <br />reyuirements. lf the land use (ails to satisfy any of the five (5) above i�quiries, the� it is not a <br />"low impact quasi-public use' under City Code. <br />A"moderate impact quasi-public use" means activities that are: <br />(1) Sponsored by a quasi-public or�,anization; <br />(2) 7�he activities have a moderate impact on the surrounding properties, in terms of: <br />(a) area requirements; <br />(b) traffic generatiou; <br />(c) parking requirements; <br />(d) hours of operation; <br />(e) number of employees; or <br />(f) light or noise gencrated. <br />(3) Moderate impact on surrounding properties exists when the land use requires: <br />(a) more than ] 0 employees on site for any one activity; or <br />(b) more than 15 parking spaces for any one activity exclusive of those parking <br />spaces required for public assemblv_. <br />(4) Also, the land use must not involve: <br />(a) retailing; <br />(b) wholesaling; or <br />(c) warchousing; <br />of materials other than normal office supplies. <br />(5) Pinally, the land use renders services that are essentially public. <br />A detem�ination that a land use is a"moderate impact quasi-public use" must meet the five (5) <br />above requirements. If the land use fails to satisfy any of the five (5) above inquiries, then it is <br />not a"modera[e impact quasi-public use" under City Code. <br />The city council in its analysis will need to deterniine if the church is a"quasi-public <br />organization." lt will also need to detennine if the community garden requires more than 15 <br />parking spaces for "public assembly" and whether it is an "esscntially public" service. <br />l he appcal's lourih basis claims that the proposed land use has a significant likelihood of <br />causing nuisa�ces.
