--• <br />.-. <br />Draft Resolution Attachment H <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />� Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />2 Roseville, County of Ramsey, Minnesota, was held on the 14th day of January, 2008, at 6:00 p.m. <br />a The following members were present: ; <br />5 and were absent. <br />s Council Member introduced the following resolution and moved its adoption: <br />� RESOLUTION NO. <br />s A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />9 WITH §1005.015 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR RIAZ AND <br />� o CATHERINE HUSSAIN AT 1901 LEXINGTON AVENUE (PF07-069) <br />� t WHEREAS, Riaz and Catherine Hussain own the property at 1901 Lexington Avenue, of <br />� 2 which Michael Schueller is a prospective buyer; and <br />�3 WHEREAS, the subject property is legally described as: <br />�a Section 15 Township 29 Range 23, subj. to hwy. and street, part of the N'/a of the NE'/4 of <br />15 the SE'/4 E of Ed Bossards Addition Plat 2 and S of the Gne beginning on the E line of said <br />16 1/4'/4 and 183 ft. S from the NE corner thereof thence W at right angle 89 ft. thence N and <br />� � parallel with said E line 18 ft. thence W at right angle to E line of said plat <br />� s PIN: 15-29-23-41-0030 <br />i 9 WHEREAS, Michael Schueller seeks to operate a catering facility, which is a <br />2o conditionally permitted use in the Limited Retail Business Zoning District; and <br />2� WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />22 requested CONDITIONAL USE PERMIT, voting 5-2 to recommend approval of the request <br />23 based on the comments and findings of the staff report dated December 5, 2007; and <br />2a WHEREAS, the Roseville City Council has determined that approval of the requested <br />25 CONDITIONAL USE PERMIT will not adversely affect conditions on nearby properties and <br />25 will not compromise the health, safety, and general welfare of the citizens of Roseville; <br />2� NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />2� the request by Michael Schueller for a CONDITIONAL USE PERMIT in accordance with <br />2� Section § 1013.01 of the Roseville City Code, subject to the following conditions; <br />so 1.
