Regular Planning Commission Meeting <br />Minutes – Wednesday, May 1, 2013 <br />Page 3 <br />Mr. Westad thanked the Commission for their consideration, and concurred with staff’s <br />96 <br />report. Mr. Westad noted that this encroachment had occurred over the last 2-3 decades, <br />97 <br />with many property owners assuming the area was part of their land; and opined that this <br />98 <br />seemed to be the best way to make five property owners happy. <br />99 <br />At the request of Member Murphy, Mr. Westad advised that his father-in-law built the <br />100 <br />current home at 986 Millwood Avenue in 1976, and used some of the property for a <br />101 <br />hockey rink for many years. Upon Mr. Westad’s purchase of the home from his father-in- <br />102 <br />law, and a deer feeder located in the area, with Ramsey County doing a deer count and <br />103 <br />finding the encroachment(s), this had precipitated tonight’s request. Mr. Westad opined <br />104 <br />that this appeared to be a favorable solution for all, with neighbors having shared in the <br />105 <br />cost of appraisals to achieve resolution. <br />106 <br />Chair Gisselquist provided an opportunity for other co-applicants to speak, but of the <br />107 <br />three (3) property owners represented, none chose to come forward. <br />108 <br />Chair Gisselquist closed the Public Hearing at 6:59 p.m.; no one appeared for or against <br />109 <br />Member Olsen spoke in support of the proposal, opining that it was a win/win for all <br />110 <br />property owners; and expressed his appreciation to see a neighborhood collaborate on a <br />111 <br />good solution for all parties concerned. <br />112 <br />MOTION <br />113 <br />Member Olsen moved, seconded by Member Daire to recommend to the City <br />114 <br />Council APPROVAL of the proposed COMPREHENSIVE LAND USE PLAN MAP <br />115 <br />CHANGE, ZONING MAP CHANGE, AND RECOMBINATION MINOR SUBDIVISION at <br />116 <br />986 Millwood Avenue, 2961 Chatsworth Street, 2967 Chatsworth Street, 2983 <br />117 <br />Chatsworth Street, and 2991 Chatsworth Street; based on the comments and <br />118 <br />findings of Sections 4-6 and the recommendation of Section 7 of the staff report <br />119 <br />dated May 1, 2013. <br />120 <br />Ayes: 7 <br /> <br />121 <br />Nays: 0 <br />122 <br />Motion carried. <br />123 <br />At the request of Member Daire, City Planner Paschke reviewed the administrative <br />124 <br />process for Comprehensive Plan Land Use and Zoning Boundary revisions, including <br />125 <br />notice and comment opportunity by adjacent municipalities and the Metropolitan Council. <br />126 <br />Mr. Paschke advised that, if the City Council supports the recommendation of the <br />127 <br />Planning Commission, staff would then follow-through with the necessary actions, <br />128 <br />including ordinance and map approvals creating those changes. <br />129 <br />At the request of Member Murphy, Mr. Paschke outlined a possible timeframe, but <br />130 <br />advised that it would be dependent on the comments of those other jurisdictions. <br />131 <br />Anticipated City Council action is scheduled for May 20, 2013. <br />132 <br />b. PLANNING FILE 13-005 <br />133 <br />Request by Landmark 6 of Roseville, LLC for approval of a PRELIMINARY PLAT of <br />134 <br />an unaddressed residential parcel on Millwood Avenue between Victoria and <br />135 <br />Chatsworth Streets <br />136 <br />Chair Gisselquist opened the Public Hearing for Planning File 13-005 at 7:03 p.m. <br />137 <br />Mr. Lloyd reviewed the proposed plat approval, a form of subdivision process, west of <br />138 <br />Victoria Street on Millwood Avenue; and staff’s technical analysis of the request as <br />139 <br />detailed in the staff report. Mr. Lloyd advised that the proposed plat was intended to <br />140 <br />accommodate six (6) one-family residential lots around a short cul-de-sac street. Further <br />141 <br />background was provided in Sections 4.1 and 4.2 of the staff report. <br />142 <br />Mr. Lloyd reviewed the shown right-of-way for the proposed plat narrower than code <br />143 <br />provisions; however, Mr. Lloyd advised that the section of code provided flexibility for less <br />144 <br />than standard if approved by the City’s Public Works/Engineering Department for any <br />145 <br /> <br />
