Attachment F <br />1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />PUBLIC IMPROVEMENT CONTRACT <br />11 <br />JOSEPHINE HEIGHTS <br />12 <br />13 <br />14 <br />Parties. <br />I.This Agreement, dated __________________, 2013, is entered into between the City of <br />15 <br />Roseville, a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, <br />16 <br />City <br />Minnesota 55113 (“the ”), and Landmark 6 of Roseville, LLC, a Minnesota limited liability <br />17 <br />company whose address is 13432 Hanson Blvd. NW, Andover, MN 55304 (collectively the <br />18 <br />Developer <br />“”). <br />19 <br />Request for Plat approval. <br />II.The Developer has asked the City to approve a plat of land to be known <br />20 <br />Josephine Heights <br />as “”(also referred to in this Agreement as the “Plat”). The land is legally <br />21 <br />described as follows: <br />22 <br />See Legal Description attached as Exhibit Ahereto (the “Property”). <br />23 <br />24 <br />Terms and Conditions of Plat Approval. <br />III. For good and valuable consideration, the receipt and <br />25 <br />sufficiency of which are hereby acknowledged, the parties agree as follows: <br />26 <br />Plat Approval: <br />A.Subject to the terms and conditions of this Public Improvement Contract, the <br />27 <br />recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />28 <br />of the Plat. <br />29 <br />Land Use: <br />B.The Plat consists of 6 single-family lots. The Property is to be improved with the <br />30 <br />following: a cul-de-sac and curbing; bioretention ponds; sanitary sewer lines,water main lines and <br />31 <br />hydrants, and storm sewer lines with structures. <br />32 <br />Public Improvements. <br />C. The Developer shall, subject to the terms and conditions contained herein, <br />33 <br />perform the following work and construct the following improvements (“Public Improvements”) in <br />34 <br />compliance with City approved Public Improvement Construction Plans described in Section III D <br />35 <br />below and all rules, regulations, standards and ordinances of the City: <br />36 <br />1.Site Grading and Turf Restoration. The Developers shall grade the Property in <br />37 <br />accordance with the City approved Grading, Drainage and Erosion Control Plan. Site <br />38 <br />grading improvements shall include common excavation, subgrade correction, <br />39 <br />embankment and pond excavation. The Developer shall implement turf restoration on <br />40 <br />the Property which shall include seeding, mulching and erosion control. <br />41 <br />a)The Developer shall submit to the City a Grading, Drainage and Soil Erosion Plan for <br />42 <br />all of the Property acceptable to the City showing the grades and drainage for each lot <br />43 <br />prior to installation of the improvements. <br />44 <br />Page 1 of 15 <br /> <br />
