Attachment F <br />EXHIBIT B <br />1 <br />Conditions of Development <br />2 <br />3 <br />1.All property owners shall either dedicate on the Plat or otherwise convey all roadway, utility, <br />4 <br />drainage, and other easements required by the City. <br />5 <br />6 <br />2.The access points to enter and exit the Property shall be at locations approved by the City and any <br />7 <br />other governmental entity having jurisdiction over adjacent roadways. <br />8 <br />9 <br />3.The Developer shall install subdivision monuments as reasonably required by the Roseville Public <br />10 <br />Works Department and Ramsey County Surveyor. <br />11 <br />12 <br />4.The Developer shall provide the City proof that the Developer/Owner is the fee simple owner of all <br />13 <br />of the Property included in the Plat and that there are no liens, encumbrances or other parties having <br />14 <br />an interest in the Property at the time the Plat and the Development Agreement are recorded, or <br />15 <br />make other arrangements which are reasonably satisfactory to the City to assure that title to the <br />16 <br />Property following the recording of the Plat and the Development Agreement shall be acceptable to <br />17 <br />the City. <br />18 <br />19 <br />5.The Developer shall pay all unpaid City subdivision review and other fees prior to the City releasing <br />20 <br />the Plat for recording. <br />21 <br />22 <br />6.No building permits shall be issued for any use of the Property which is not a permitted use. <br />23 <br />24 <br />7.The Developer shall form a Homeowner’s Association(s) which will, among other things, be <br />25 <br />responsible for the maintenance and repair of various amenities on the Property. The Homeowner’s <br />26 <br />Association documents shall be subject to the approval by the City Attorney and Staff. No work <br />27 <br />shall commence on the Property until such approval is given unless otherwise designated by the City <br />28 <br />Engineer in writing. <br />29 <br />30 <br />8.The Developer shall enter into and record a Public Improvement Easement and Maintenance <br />31 <br />Agreement which has been agreed to and signed by the City and all parties having an interest in the <br />32 <br />Property immediately after recording this Public Improvement Contract. <br />33 <br />34 <br />9.The Developer shall convey ownership of Outlots A and B to the City. <br />35 <br />36 <br />Page 15of 15 <br /> <br />
