4.0B <br />12 <br />ACKGROUND <br />13The property at 2645 Snelling Avenue has a Comprehensive Plan Land Use designation <br />14of Community Business (CB) and a zoning classification of Community Business (CB) <br />15District. <br />5.0VA <br />16 <br />ACATIONNALYSIS <br />17The Public Works Department staff has reviewed the proposed vacation/relocation of the <br />18sanitary sewer and easement as illustrated in Attachment C and is supportive of vacating <br />19the portion at the southwest corner of the property to a location near the northeast corner <br />20of the property and will accept the rededication of the easement as proposed and the <br />21reconstruction of the sewer in the same location. <br />22Since the Planning Commission is responsible for holding the public hearings for <br />23applications like the proposed vacation, Planning Division staff is preparing the report <br />24and supporting materials for review. But the Planning staff doesn’t have an interest, per <br />25se, in such proposals and merely conveys the comments and recommendation of the <br />26Public Works Department in addition to coordinating the review of the proposal by the <br />27Planning Commission and City Council. The Planning Division will become involved <br />28when formal plans for the site redevelopment are submitted for building permit review <br />29and approval. <br />6.0PC <br />30 <br />UBLICOMMENT <br />31The duly-noticed public hearing for this application was held by the Planning <br />32Commission on July10, 2013; no members of the public were present to comment on the <br />33proposal. After closing the public hearing, the Planning Commission voted (6-0) to <br />34approve the requested ; draft minutes of the public hearing are <br />EASEMENTVACATION <br />35included with this report as Attachment E. As of the time this report was prepared, <br />36Planning Division staff had not received any calls or email regarding easement vacation. <br />7.0R <br />37 <br />ECOMMENDATION <br />38Based on the comments and findings outlined in Sections 5 and 6 of this report, the <br />39Planning Division recommends approval of the E V of the sanitary <br />ASEMENTACATION <br />40sewer easement as described and illustrated on Attachment C for property at 2645 <br />41Snelling Avenue.
