<br />EXTRACT OF MINUTES OF MEETING <br />OF CITY COUNCIL <br />OF CITY OF ROSEVILLE <br />RAMSEY COUNTY, MINNESOTA <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, <br />Minnesota, was held in the City Hall in said City on Monday, February 28, 2000 at 6:30 o'clock p.m. <br /> <br />The following members were present: Goedeke, Mastel, Wiski, Maschka & Kysylyczyn, and the <br />following were absent: none. <br /> <br />Council member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION 9749 <br /> <br />RESOLUTION APPROVING A LIMITED USE PERMIT <br />AGREEMENT BETWEEN MN/DOT AND THE CITY OF ROSEVILLE <br />TO OPERATE AND MAINTAIN THE DALE STREET PATHWAY <br />WITHIN MN/DOT RIGHT -OF-WAY <br /> <br />WHEREAS, the City of Roseville, Minnesota, is constructing a multi-use pathway along Dale Street <br />from Larpenteur Avenue to County Road C (SP 160-090-05, TEA 6200(248)); <br /> <br />AND WHEREAS, Dale Street intersects Trunk Highway No. 36 right-of-way; <br /> <br />AND WHEREAS, Mn/DOT requires the City of Roseville to acquire a Limited Use Permit in order <br />to construct, operate, and maintain the pathway within Mn/ DOT right-of-way; <br /> <br />THEREFORE BE IT RESOL VED by the City Council of the City of Roseville, Minnesota, that the <br />Mayor and the City Manager are hereby authorized and directed for and on behalf of the City to <br />execute and enter into an agreement with the State of Minnesota Department of Transportation <br />prescribing the terms and conditions of said Limited Use Permit as set forth and contained in <br />"Minnesota Department of Transportation Limited Use Permit", a copy of which said agreement was <br />before the City Council and which is made a part hereof by reference. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Member Mastel, upon <br />a vote being taken thereon, the following voted in favor thereof: Goedeke, Mastel, Wiski, Maschka <br />& Kysylyczyn, and the following voted against the same: none. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
