REQUEST FOR COUNCIL ACTION <br /> Date: 08/12/13 <br /> Item No.:7.e <br />Department Approval City Manager Approval <br />Item Description: Approve Maintenance Agreement for Stormwater Management Facilities between <br />Rice Creek Watershed District and the City of Roseville for M-12-13 Twin Lakes <br />Area Street Improvements Project <br />Page 1 of 2 <br />B ACKGROUND 1 <br />The 2013 Twin Lakes Area Street Improvement Project consists of the public street improvements 2 <br />required for the construction of the Wal-Mart in the Twin Lakes Redevelopment Area. This project 3 <br />includes the following work: 4 <br />x Right turn lane on County Road C into the Wal-Mart Parcel; 5 <br />x Eastbound left turn lane and median improvements into the Wal-Mart Parcel and westbound left 6 <br />turn lane on County Road C to southbound Cleveland Avenue; 7 <br />x Right turn lane on Twin Lakes Parkway into the Wal-Mart Parcel; 8 <br />x Right turn lane from westbound County Road C to northbound Cleveland; and 9 <br />x Twin Lakes Parkway Roundabout Improvements. 10 <br />This project modifies the existing storm water management facilities that were constructed as a part of 11 <br />the 2009 Twin Lakes Infrastructure project. As a result it is necessary to modify the original agreement 12 <br />for these facilities. The modifications include the removal of an existing infiltration swale and the 13 <br />construction of an infiltration basin, as well as new catch basins and pipes. All of this is being 14 <br />constructed within the right- of- way as part of the project. These facilities are necessary to meet Rice 15 <br />Creek Watershed District’s storm water treatment requirements and the City’s Green Infrastructure 16 <br />goals.17 <br />The District requires the installation and maintenance of new storm water management facilities 18 <br />according to the district rules for city public works’ projects, including street reconstruction projects.19 <br />One of the permit requirements is to enter into a Maintenance Agreement covering the maintenance of 20 <br />the new storm water management facilities. 21 <br />P OLICY O BJECTIVE 22 <br />This agreement will cover the storm water management facilities constructed in association with this 23 <br />project. Maintenance of storm water facilities is required by our Minnesota Pollution Control Agency 24 <br />Storm Water Pollution Prevention Permit (SWPPP). It is also consistent with our Public Works Policies 25 <br />to adequately maintain infrastructure. 26 <br />F INANCIAL I MPACTS 27 <br />The Public Works Department is committed to maintaining storm water facilities when they are 28 <br />installed. This agreement does not increase our level of maintenance over what we would have done 29 <br />without the agreement. 30
