<br />Extract of Minutes of Meeting of the City Council <br />Of the City of Roseville <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of <br />the City ofRoseville, County of Ramsey, Minnesota, was duly called and held at the City <br />Hall on Monday, the 10th day of April, 2000 at 6:30 p.m.. <br /> <br />The following members were present: Wiski, Goedeke, Mastel and Kysylyczyn <br />and the following were absent: Maschka <br /> <br />Council Member Wiski introduced the following resolution and moved its adoption: <br /> <br />Resolution No. 9760 <br />Resolution Denying a Variance for <br />Bradley Operating Limited Partnership at Har Mar Mall (PF3194) <br /> <br />WHEREAS, Bradley Operating Limited Partnership, as owner of the Har Mar <br />Mall, filed an application for a variance from Section 1006.02C (Lot Coverage) and <br />Section 1011.02 (Non-conforming Uses: Existing Structures or Uses) of the Roseville <br />City Code to allow the construction of an additional 18,508 square feet of retail, enclosed <br />delivery and enclosed trash area at the Har Mar Mall; and, <br /> <br />WHEREAS, the application was accepted as complete on February 18,2000; and, <br /> <br />WHEREAS, after due notice the Roseville Planning Commission held a public <br />hearing regarding the variance application in accordance with state law and city <br />ordinance on March 8, 2000, at which time oral and written testimony was presented by <br />the applicant, its agents, residents and other interested persons; and, <br /> <br />WHEREAS, at the conclusion of the public hearing the Planning commission <br />voted 4-3 to recommend that the City Council deny the variance after finding that the <br />strict enforcement of the existing ordinances would not cause an undue hardship on the <br />applicant; and, <br /> <br />WHEREAS, the City council at its regular Council meeting on March 27th <br />received the Planning Commission's recommendation, further written and oral testimony <br />from the applicant and other interested persons; and, <br /> <br />WHEREAS, upon consideration of the application and supporting materials, the <br />staff report, and all other information constituting the record of this application, and upon <br />further deliberation, the Council voted 4-1 to deny the variance and directed the City <br />Attorney to prepare findings and this resolution as a contemporaneous record of the <br />Council's decision. <br /> <br />NOW, THERFORE BE IT RESOLVED, by the City Council of the City of <br />Roseville, Minnesota that it adopts and memorializes the following findings regarding the <br />subject application for a variance: <br />
