EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota,was held on the 23rd day of July 2012 at 6:00 p.m. <br /> The following Members were present: McGehee, Pust, Roe, Johnson, Willmus; <br /> and no member were absent. <br /> Council Member Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 10995 <br /> A RESOLUTION APPROVING THE TWIN LAKES 2"ADDITION PLAT AND <br /> ASSOCIATED DEVELOPMENT AGREEMENT (PF12-001) <br /> WHEREAS, an application for approval a final plat of the land which is shown on <br /> Exhibit A, attached hereto, and an associated Development Agreement have been prepared <br /> pursuant to the requirements of the City of Roseville Zoning Code and submitted to the City of <br /> Roseville, and <br /> WHEREAS, Wal-Mart Real Estate Business Trust intends to purchase the entirety of the <br /> property being platted; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Roseville, <br /> Minnesota that based on the comments and findings of Sections 4—7 and the recommendation <br /> and conditions of Section 8 of the staff report prepared for this action, the TWIN LAKES 2ND <br /> ADDITION FINAL PLAT of the subject property is hereby approved, subject to the following <br /> conditions: <br /> a. Wal-Mart Real Estate Business Trust shall enter into a development agreement <br /> pertaining to the plat which is satisfactory to the City. Such development agreement <br /> shall include the requirement that Wal-Mart enter into a security plan approved by the <br /> Roseville Police Chief which identifies and incorporates on-site technology, <br /> personnel, and practices to improve security, minimize losses, and better <br /> communicate with the Police Department. If a mutually agreeable security plan <br /> cannot be developed, Wal-Mart shall pay for costs related to calls for law enforcement <br /> service at the Property in excess of 300 calls per year. Calls for law enforcement <br /> service shall include any calls or service in which persons employed by the City and <br /> assigned to the Roseville City Police Department are involved. The cost for each call <br /> in excess of 300 per year shall be determined by adding the cost of all City employees <br /> (including administrative employees) involved in receiving, responding to or <br /> providing service with respect to the call. Each employees cost shall be determined by <br /> multiplying the employee's hourly rate times 1.9,times the number of hours (or <br /> portion thereof) expended by such employee regarding the call. Payment shall be <br /> made within 30 days of the delivery by the City upon Wal-Mart of a written invoice <br /> stating the amount due for each call in excess of 300 per year.
