EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE * * * * * * * Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was duly held on the 28st day of October, 2013, at 6:00 p.m. The following members were present: Willmus, Laliberte, Etten, McGehee and Roe the following members were absent: none. Councilmember McGehee introduced the following resolution and moved its adoption: RESOLUTION No. 11101 A RESOLUTION ACCEPTING A GIFT OF REAL PROPERTY LOCATED IN ROSEVILLE,MINNESOTA WHEREAS, Timothy G. Miley and Nancy E. Wenkel, as personal representatives of the Estate of Eileen G. Miley, a/k/a Eileen Genevieve Miley, and Timothy G. Miley and Nancy E. Wenkel, as trustees of the Eileen Miley Trust dated May 24, 1993, as amended, desire to give and convey to the City of Roseville fee simple ownership to real property located within the City legally described as follows: Lot 19, Block 2, Garcelon's Addition to Saint Paul ("Property"); and WHEREAS, Minnesota Statutes § 465.03 authorizes the City to accept a gift of real property by a Resolution of the City Council adopted by a two-thirds majority vote of its members; and WHEREAS, the Roseville City Council has determined that acquiring fee simple ownership of the property would be beneficial to the City, that it would be in the best interest of the City to accept the gift of said real estate, and as a result thereof it desires to acquire said real property; and WHEREAS, the Roseville City Council has dispensed with the requirements of Minnesota Statutes § 462.356, Subd. 2, that require the Roseville Planning Commission to conduct a Comprehensive Plan compliance review of said property acquisition because it finds that the proposed acquisition has no relationship to the Roseville Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED that the Roseville City Council, on behalf of the City of Roseville, hereby accepts the gift of the Property described herein. The motion for the adoption of the foregoing resolutions was duly seconded by Councilmember Etten, and upon vote being taken thereon the following voted in favor
