The City shall require any <br />contractor or subcontractor performing work on the Property in accordance with this <br />Agreement to maintain sufficient insurance coverage for the project and to name the <br />Owners as additional insureds on such coverage. <br />10. Attorney's Fees. In the event of litigation between the parties related to this <br />Agreement or its breach, the prevailing party will be entitled to recover from the other <br />party, 'in addition to other relief as may be granted, a reasonabte sum, as and for its <br />attorney's fees and other costs incurred as may be determined by a court of competent <br />jurisdiction. <br />It. Equal Drafting. This Agreement must be construed to have been drafted equally <br />by the parties. <br />12. Complete Agreement. "Mis Agreement, and the Settlement Agreement'. <br />constitute the entire agreement between the parties related to the demolition of the <br />Buildings and assess ,men t of the costs of said demolition and expressly supersedes and <br />terminates any and all agreements, promises, representations, or understandings between <br />the parties. Thi's Agreement is executed without any reliance upon any statement or <br />representation by either party, or its representatives or agents. <br />13. Binding Effect. All provisions herein shall run with the land and shall extend to <br />and bind the heirs, successors, representatives, and assigns of Owners. This Assessment <br />Agreement may not be, assigned by the Owners. without the prior written consent of the <br />citys <br />14. Severabilifty.
