Attachment B <br />MEMORANDUM <br />T: Pat Trudgen and Roseville City Council <br />FROM: Tammy McGehee <br />DATE: November 2 , 2013 <br />RE: Liquor Licensing for Total 'amine and More <br />Following the Council Meeting on Monday, November 20, I was disturbed by the seriousness of <br />the allegations against the potential applicant that have been brought in other jurisdictions where <br />he has operated his businesses. After some research, I have found that we have serious <br />obligations as grantors of these licenses and are woefully lacking ing in our ability to review the <br />operations of an applicant with a history of such serious and varied allegations. In materials <br />from the Bloomington City Attorney (attached hereto), she rites: <br />Summary.- 10 cases since 1991. In November 2009, Total Tine and More paid at least <br />$1 million in fines for failure to maintain or produce tree boob our se ra e *, - s e <br />licenses. The fines were paid in lieu of30 day license suspensions. Other offenses <br />include incomplete or unavailable employee list, no current license application, no <br />federal c stamp and under age sales. <br />At the same time when these allegations were brought before us, they were lightly reviewed, <br />discussed, and dismissed. We were told that these natters were for state licensing and <br />permitting, not for the City of Roseville. This is clearly incorrect as shown in a quote from an <br />Information Brief from the Research Department of the MN House of Representatives: <br />Minnesota is relatively unusual among states in that almost all its retail liquor <br />licenses are issued locally rather than by a state agency. This information brief <br />describes the various types of retail licenses that are authorized by Minnesota <br />law. <br />This applicant has also filed a false application by failing to mention the nearly $1 <br />million dollars in fines assessed in New Jersey. This action alone should disqualify <br />him as a candidate to hold a license in Roseville or the State of Minnesota both under <br />our statute and state law. <br />As you review the attached documents, I hope you will consider waiting to rule on <br />this application until we are able to review all the information provided to the <br />Bloomington City Council on December 16, 2013 and their decision. <br />
