Mr. Erlick referenced the attempt by World Market Cost Plus to obtain <br /> their former liquor license when they reopened in Roseville recently, at which <br /> time he and World Market representatives were told that if they wanted a license, <br /> they would have to buy one from a current license holder, with the City retaining <br /> its philosophy for only 10 off-sale licenses. Therefore, Mr. Erlick advised that <br /> this is what they did; and opined that they had complied candidly with all of the <br /> City's regulations; and respectfully urged the City Council to approve this license <br /> transfer. <br /> Debra Page,Attorney representing Total Wine & More <br /> Ms. Page clarified that Total Wine had submitted their license to the City at this <br /> time at the direction of City of Roseville staff to allow the City to consider that <br /> application along with other license renewals. If the City Council chose to delay <br /> that approval, Ms. Page advised that this would not be problematic for the appli- <br /> cant. However, Ms. Page asked that the City Council refocus on the suitability of <br /> the premises and the applicant, having complied with all requirements and then <br /> some. <br /> Ms. Page further clarified that most of those allegations as referenced by previous <br /> speakers were not allegations against Total Wine, but also other litigation which <br /> would be typical of any business with over 90 locations and operating for over 20 <br /> years. Ms. Page opined that most similar business entities would have experi- <br /> enced 10 or more litigations; and that this should not be indicative of a lack of <br /> good moral character. <br /> Ms. Page reiterated that the applicant would not stand in the way if the City <br /> Council preferred to delay action; and that they were simply complying with <br /> staff s request to bring this application forward at this time. <br /> Mayor Roe closed the Public Hearing at approximately 9:38 p.m. <br /> Councilmember Willmus asked City Attorney Gaughan for his legal opinion, after <br /> his review of the additional information provided; and whether he saw any reason <br /> to delay action or withhold the transfer. <br /> City Attorney Gaughan displayed the information he had received from the Min- <br /> nesota Licensed Beverage Association, as well as significant amount of materials <br /> provided to him from the applicant fully disclosing litigation in other states. Mr. <br /> Gaughan noted that he found that the litigation dealt predominantly with the man- <br /> ufacture, distribution and retailer structures primarily and the applicant's owner- <br /> ship of state licenses. Mr. Gaughan noted that other litigation involved the appli- <br /> cant as plaintiff's to dissolve disputes. <br />
